About introduction of amendments to article 4 of the Law on Chamber of Commerce and Industry No. 393/1999

The Parliament adopts this organic law.

Art. I. - In article 4 of the Law on Chamber of Commerce and Industry No. 393/1999 (Official monitor of the Republic of Moldova, 1999, Art. No. 73-77, 343), with subsequent changes, to make the following changes:

Item g) parts (to state 2) in the following edition:

"g) certifies by issue of the conclusion (the conclusion about confirmation) according to the procedure established by Chamber the circumstances which came owing to the natural phenomena, normative/administrative acts, actions or failure to act (facts) or others uncontrollable to the debtor of phenomena/events which can be acknowledged as justified obstacle for obligation fulfillment by the debtor within commercial contractual relations in which at least one party is subject of business activity and the party of these contractual relations agreed in writing about the certificate Chamber of above-mentioned circumstances;";

add Article with part (3) the following content:

"(3) Item g Provisions) parts (2) are not given to the conclusion of Chamber of the preset evidential force and do not exclude admissibility of other proofs confirming the specified circumstances. The degree of jurisdiction or other competent authority of jurisdiction estimates according to the law of circumstance, certified in the conclusion specified in Item g) parts (2).".

Art. II. - (1) the Certificates on confirmation of availability of force majeur circumstances issued by Chamber of Commerce and Industry about day of entry into force of this law are equated to the conclusions issued according to provisions of article I of this law.

(2) Statements for issue of certificates on confirmation of availability of force majeur circumstances which consideration is not complete about day of entry into force of this law are considered according to the procedure, established by this law.
