About introduction of amendments to article 71 of the Law of Ukraine "About enforcement proceeding" about obligation of the contractor to make indexation of the size of the alimony determined by court in firm sum of money

1. Bring in article 71 of the Law of Ukraine "About enforcement proceeding" (Sheets of the Verkhovna Rada of Ukraine, 2016, No. 30, Art. 542; 2018, No. 36, Art. 272) following changes:

Part one to add 1) with paragraphs the third and fourth such content:

"Indexation of the size of the alimony determined in firm sum of money is made if other is not provided in the executive document or in the contract between parents on payment of child maintenance, the contractor in the procedure established by the Cabinet of Ministers of Ukraine. Indexation of the size of the alimony is made annually, since second year after determination of the size of the alimony.

In case of the independent direction the claimant of the executive document directly to the company, organization, the organization, physical person - the entrepreneur or the physical person specified in part one of article 7 of this Law, indexation of the size of the alimony determined in firm sum of money is made if other is not provided in the executive document or in the contract between parents on payment of child maintenance, according to the Law of Ukraine "About indexation of cash incomes of the population";

2) the first offer of paragraph one of part four to state in the following edition:

"4. The contractor shall estimate the size of debt on payment of the alimony monthly, and also carry out indexation of the size of the alimony according to part one of this Article".

2. This Law becomes effective from the date of, its publication following behind day.
