About modification of the Regulations on passing by citizens of Ukraine of military service in the State Border Service of Ukraine

1. Bring in the Regulations on passing by citizens of Ukraine of military service in the State Border Service of Ukraine approved by the Presidential decree of Ukraine of December 29, 2009 No. 1115, the following changes:

Items 3, of 10, of 17, of 18, of 20, of 23, of 24, of 32, of 37, of 53, of 62, of 111, of 114, of 132, of 135, of 136, of 152, of 206, of 221, of 270, of 291, 301 and the Section XIV to state 1), respectively in the following edition:

"3. In State frontier service citizens pass in voluntary procedure:

military service (training) in the contract of cadets (listeners) in the highest military educational institution;

military service under the contract of faces of ordinary structure;

military service under the contract of faces of sergeant and foreman structure;

military service under the contract of faces of officers.

The contract is signed with citizens who voluntarily enlist (further - military service under the contract).

At the call of citizens pass:

compulsory military service;

military service during mobilization, for the special period;

military service of faces of officers";

"10. The military personnel can be directed from their consent for passing of military service in other military forming formed according to the laws of Ukraine, law enforcement agencies of special purpose and the Public special service of transport (further - other military forming) with their exception of lists of staff of bodies of State frontier service.

Military personnel of other military forming, citizens of Ukraine who have special ranks of average of the senior and highest commanding structure or class ranks and serve in law enforcement agencies or in Public service of special communication and information security of Ukraine, can be accepted on military service under the contract in State frontier service with their transfer in lists of staff of bodies of State frontier service after their exception of lists of staff of other military forming, law enforcement agencies or Public service of special communication and information security of Ukraine.

Citizens of Ukraine who have special ranks of average the senior and highest commanding structure or class ranks and serve in law enforcement agencies or in Public service of special communication and information security of Ukraine, are accepted on military service under the contract of faces of officers in State frontier service with simultaneous assignment of military ranks by it according to the procedure of the recertification which is carried out with observance of requirements of this provision.

The direction of the military personnel from State frontier service in other military forming or from other military forming (law enforcement agency, public service of special communication and information security of Ukraine) in State frontier service is performed under approval between the chairman of the State Border Service of Ukraine and the head of the relevant ministry, other central executive body which according to the law performs management of military forming or law enforcement agency, with the consent of the serviceman (person who the special rank or the class rank has) and is drawn up by orders of the chairman of the State Border Service of Ukraine.

Military personnel of State frontier service who was accepted for passing of military service in prospecting bodies of Ukraine with their exception of lists of staff of bodies of State frontier service have the right to return in the procedure established by the legislation to State frontier service in the presence of vacant position for further passing of military service with transfer in uninterrupted length of service of time service of stay in prospecting bodies of Ukraine";

"17. The contract - the written agreement signed according to the requirements determined by this Provision between the citizen and the state on behalf of which the authorized body of State frontier service, for establishment of legal relations between the parties acts during passing of military service is signed with the citizen who enlists.

The following contract types can be concluded with the citizen who enlists:

the contract on passing by citizens of Ukraine of military service in the State Border Service of Ukraine on positions of faces of ordinary structure (appendix 1);

the contract on passing by citizens of Ukraine of military service in the State Border Service of Ukraine on positions of faces of sergeant and foreman structure (appendix 1);

the contract on passing by citizens of Ukraine of military service in the State Border Service of Ukraine on positions of faces of officers (appendix 1);

contract on passing of military service (training) by cadets of the highest military educational institution of the State Border Service of Ukraine (appendix 2);

18. The first contract on passing of military service is signed:

with persons who are accepted to positions of ordinary structure, - for a period of 3 years;

with persons who are accepted to positions of sergeant and foreman structure, - from 3 to 5 years depending on the consent of the parties;

with cadets of final year of the highest military educational institutions, and also military educational units of higher educational institutions which preparation is performed according to the state order, after the termination of these educational institutions, about passing of military service on positions of faces of sergeant and foreman structure, faces of officers - for a period of 5 years;

with citizens who are accepted on military service under the contract of faces of officers, - from 1 to 5 years, depending on the consent of the parties";

"20. The term of passing of military service can be prolonged under the new contract before age achievement of limit of stay on military service:

for the military personnel who passes military service on positions of ordinary structure, - for 3 years;

for the military personnel who passes military service on positions of sergeant and foreman structure - from 3 to 5 years;
