in Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan, approved by the specified order:

"1. These rules of certification and issue of the certificate of the flight validity of civil aircrafts of the Republic of Kazakhstan (further - Rules) are developed according to subitem 41-22) of Item 1 of Article 14, articles 38 and 47 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further - the Law on the state services) and requirements of International Civil Aviation Organization (further - ICAO).

2. These rules determine procedure for certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan (further - Rules) and rendering the state services "Issue of the Certificate of the Flight Validity of the Civil Aircraft", "Issue of the Certificate of the Aircraft on Noise", "Issue of the Decision on Recognition of the Certificate of the Flight Validity of the Civil Aircrafts Issued by Foreign State", "Issue of Permission to Accomplishment of Special Flight", "Issue of Permission to Use of the Radio-transmitting Equipment" and "Issue of the Export Certificate of the Flight Validity" (further - the state services in the field of maintenance of the flight validity).";

state Items 7 and 8 in the following edition:

"7. For receipt of the certificate of the flight validity of the civil aircraft the applicant sends to authorized organization through office of authorized organization or the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal) the request, in form according to appendix 1 to these rules and document package according to the list provided in the standard of the state service "Issue of the Certificate of the Flight Validity of the Civil Aircraft" (further - the Standard on issue of the certificate of the flight validity) according to appendix 2-2 to these rules.

The inspection statement of technical condition and determination of the validity of the aircraft to flights (further - the inspection statement) represented with document package is drawn up in form, according to appendix 2 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in the Standard on issue of the certificate of the flight validity.

In case of the address of the applicant through:

office of authorized organization the receipt on acceptance of the relevant documents in any form, with indication of date of acceptance, type of required state service, quantity and the name of the enclosed documents, date of issue of result of the state service is issued to the applicant;

the portal, to the applicant goes the status about acceptance of request for rendering the state service with indication of the date of receipt of result of rendering the state service to "personal account".

In case of the address of the applicant after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, registration of a statement on rendering the state service is performed the next working afternoon.

Data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur, about state registration of the civil aircraft, the air operator certificate, certificate on the right of accomplishment of aviation works, certificates on the right of accomplishment of flights, the authorized organization receives payment confirmation in the budget of collection for certification of the flight validity of the civil aircraft from the corresponding state information systems through lock of "the electronic government".

8. The authorized organization performs document registration, in day of their receipt.";

"8-1. The term of consideration of documents and issue of the certificate of the flight validity constitutes 20 (twenty) working days.

In case of need carrying out additional studying or check or discrepancy of the applicant to certified requirements, not interfering implementation of activities on condition of its elimination, the term of consideration is prolonged up to 20 (twenty) working days about what, before the expiration specified in part one of this Item the notification to the applicant within 3 (three) working days goes from the moment of prolongation of term of consideration, through office of authorized organization or the portal to "personal account" of the applicant".;

"9. Cases of submission by the applicant to office of authorized organization or on the portal of incomplete document package according to the list provided in the Standard on issue of the certificate of the flight validity, and (or) documents with the expired effective period authorized organization refuses reception of an application.

In case of representation by the applicant of complete document package, provided in the Standard on issue of the certificate of the flight validity, the authorized organization checks compliance of the applicant and the provided materials, the data and data necessary for rendering the state service to airworthiness standards of the civil aircrafts of the Republic of Kazakhstan approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 367 (it is registered in the Register of state registration of regulatory legal acts for No. 12038) (further - airworthiness standards of civil aircrafts of the Republic of Kazakhstan), the Law and to the ICAO aviation standards and performs certified inspection of the flight validity of the aircraft within 10 (ten) working days.";
