About entering of amendments into the Law "About Legal Regime of Warlike Situation"

Article 1. No. ZR-258 "About legal regime of warlike situation" (further - the Law) to add part 1 of article 8 of the Law of December 5, 2006 with the Item "with" of the following content:
"c) if necessary use of property of physical persons and legal entities according to the procedure, stipulated in Clause 8.1 presents of the Law.".
Article 2. Add the law with Article 8.1 of the following content:
"Article 8.1. Use of property of physical persons and legal entities during legal regime of warlike situation
1. During legal regime of warlike situation for the purpose of the problem resolution, caused to warlike situations, also the property of physical persons and legal entities (except for money, securities and property rights) can be used if the corresponding property, the available state, is not enough. At the same time, insufficiency of property is estimated, also considering the specific situation, urgency, the location of property and other circumstances having essential value.
2. In case of need for use of property of physical persons and legal entities heads of the state authorized bodies of the Republic of Armenia in the field of defense, homeland security, police, health care, emergency situations, economy, territorial administration and infrastructures or the officials authorized by them for this purpose (further - competent officials) offer the owner of property or, in exceptional cases, when they the owner of property or the place of its stay are unknown - to the legal manager property (further - the legal manager of property) to provide property in relevant organ for the purpose of its use.
3. In case of submission of the offer the necessary property, reasons for need of use of property (if is not secret), the obligation of the state on return of property (if necessary - on compensation), and also the warning of the fact that in case of refusal in voluntary transfer the property can be withdrawn forcibly is represented to the legal manager of property.
