About consumer protection

(as amended on on June 26, 1992)

This Law fixes legal, economic and social basis, and also guarantees of consumer protection.

State governing bodies shall perform the effective measures connected with protection of the personal rights of consumers on providing them with high-quality goods, works and services.

SECTION I. GENERAL PROVISIONS

Article 1. The purposes and the main objectives of the Law of the Kazakh SSR "About consumer protection"

The law of the Kazakh SSR "About consumer protection" is intended for regulation of the relations between the consumer and the seller or the operator and services, and is directed establishment of their rights and obligations, permission of questions of consumer protection to realization of the following tasks:

1. Recognition of priority of legitimate interests of citizens before interests of manufacturers and sellers.

2. Implementation by consumers of the rights to information, product quality, exchange of goods of proper quality, and also the rights of consumers in case of sale of goods of inadequate quality to them.

3. Consumer protection from dangers to his life and health.

4. Expansion of the international and interrepublican cooperation in the field of protection of consumer interests.

5. Assistance to creation and activities of independent groups (societies of consumers).

Article 2. Basic concepts

In this Law the following concepts are applied:

1. Consumer

- this is the citizen who buys goods and uses works and services for the purpose of private consumption or use in family household.

2. Seller

The company, the organization, organization or the citizen realizing goods according to the purchase and sale agreement.

3. Manufacturer

- the company, the organization, organization or the citizen making goods for realization.

4. Contractor

- the company, the organization, organization or the citizen the performing works or the rendering services.

5. Agreement

- the verbal or written agreement between the consumer and the seller (contractor) about quality, term, the price and other conditions on which the purchase, sale, works and services is performed.

6. Products

- goods, works, services.

7. The normative and technical document - state standards, agreements, construction regulations and rules, the state pharmacopeia and temporary pharmacopoeian Articles on medicines, specifications, technical descriptions, the compounding and other documentation fixing requirements to products which are subject to realization, work, services.

Article 3. Consumer protection law

1. The rights of consumers and the mechanism of their realization are regulated by this Law and other legal acts of the Kazakh SSR published according to it.

2. Regulations of the Cabinet of Ministers of the Kazakh SSR, the republican ministries and departments, local councils of People's Deputies cannot limit the rights of consumers and reduce guarantees of their protection in comparison with established by this Law.

Article 4. Application of the legislation "About consumer protection" one federal republic in other federal republic

1. The legislation "About consumer protection" one federal republic is applied in other federal republic according to the following rules:

- the Law of the place of acquisition of products is applied to the relations following from implementation by consumers of the rights to information, goods quality, exchange of goods of proper quality, and also the consumer's rights in case of sale of goods of inadequate quality to it and in case of breach of agreement about performance of works and rendering services if other is not stipulated by the legislation or the agreement of the parties;

- the Law of the place of consideration of dispute, and according to the petition of the consumer - the Law of the place of damnification is applied to the relations following from implementation by consumers of the rights to safety of life and health and also to the obligations following from damnification by products of inadequate quality.
