About modification of some legal acts of Ukraine concerning the right of physical person to change of middle name
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. Article 149 of the Family code of Ukraine (2002, 135) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 21-22, in the following edition:
"Article 149. Change by the child of the of surname and (or) name, and (or) middle name
1. The child who reached sixteen years has the right at discretion to change the surname and (or) own name, and (or) middle name.
2. The child who reached fourteen years has the right to change the middle name with the consent of parents.
If over the child who reached fourteen years guardianship, change of surname and (or) own name is established, and (or) middle names of such child it is performed with the consent of the custodian.
3. The child who reached fourteen years has the right to change the middle name with the consent of one of parents if the second of parents died, is acknowledged is unknown absent, is declared the dead, is acknowledged restrictedly capable, incapacitated, is deprived of the parent rights concerning this child or if the information about the father (mother) of the child is excluded from assembly record about its birth or if the information about the man as the father of the child is introduced in assembly record about its birth according to the statement of mother.
4. In case of objection of one of parents concerning change of middle name of the child, the dispute on such change can be solved guardianship and custody body or court. In case of the dispute resolution accomplishment by parents of the obligations concerning the child also other circumstances certifying compliance of change of middle name to interests of the child "are taken into account.
