About modification of some regulations
The Parliament adopts this organic law.
Art. I. - Article 6 of the Law on data exchange and interoperability No. 142/2018 (2018, Art. No. 295-308, 452) to add the official monitor of the Republic of Moldova with part (3-1) following of content:
"(3-1) Public participants shall provide provision of services without requesting documents if the data containing in these documents are available in information resources and can be consumed or delivered by means of interoperability platform.".
Art. II. - The code of the Republic of Moldova about offenses No. 218/2008 (repeated publication: 2017, Art. No. 78-84, 100), with subsequent changes to add the official monitor of the Republic of Moldova with Article 250-1 of the following content:
"Article 250-1. Violation of the law about data exchange and interoperability
(1) Unreasonable refusal of the supplier of data to provide availability of data and to provide data by means of interoperability platform, including by specifying for the purpose of refusal of the wrong, false or incomplete information or data,
attracts imposing of penalty on officials in the amount of 36 to 60 conventional units and on legal entities in the amount of 120 to 240 conventional units.
(2) Unreasonable refusal in provision of public service under the pretext of non-presentation by the applicant of documents if the data containing in these documents are available to the supplier of the corresponding public service by means of interoperability platform,
attracts imposing of penalty in the amount of 30 to 90 conventional units with deprivation of the right to hold certain position or to perform certain activities for a period of 3 months till 1 year.
(3) Non-compliance or inadequate observance by participants of data exchange of the safety requirements and confidentiality concerning data exchange
attracts imposing of penalty on officials in the amount of 36 to 60 conventional units and on legal entities in the amount of 120 to 240 conventional units.
