About modification of the Insolvency act No. 149/2012

The Parliament adopts this organic law.

Single Article. - In the Insolvency act No. 149/2012 (Official monitor of the Republic of Moldova, 2012, Art. No. 193-197, 663), with subsequent changes, to make the following changes:

1. In Article 2 in the concept "creditor" of the word "can prove the requirement" shall be replaced with words "can prove indisputability of the requirement".

2. Part (Article 20 to add 2) with Item d) the following content:

"d) the copy decisions of degree of jurisdiction or the copy of the arbitral decision which took legal effect, or the copy of the judgment on recognition of the foreign judgment or the foreign arbitral decision which took legal effect, or the decision (resolution) of the body authorized by the law which is subject to execution at that time which took legal effect.".

3. Part (Article 21 to state 2) in the following edition:

"(2) the Degree of jurisdiction considering insolvency matter considers the action for declaration with removal of determination in 20-day time after filing of application.".

4. Part (Article 28 to state 1) in the following edition:

"(1) Before removal of determination about adoption of the action for declaration to consideration, within three working days after receipt of the action for declaration of the creditor the degree of jurisdiction considering insolvency matter directs to the debtor the copy of this statement for statement it the procedural line item by giving of response to it.".
