About modification of some legal acts of Ukraine concerning protection of the rights of persons from among orphan children, children deprived of parent guardianship which establishes disability

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Family code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 21-22, 135):

Part third of Article 256-3 to state 1) in the following edition:

"3. Adopted children live and are brought up in foster home before achievement of 18-year age. After achievement of 18-year age such persons in case of continuation of training in organization of general average, professional (professional), professional prehigher or higher education can continue, at their choice, to live and be brought up in this family before the termination of such organization.

Persons from among the orphan children and children deprived of parent guardianship which establishes disability at their choice can continue to live and be brought up in foster home before achievement of 23-year age by them irrespective of whether they study in organization of general average, professional (professional), professional prehigher, higher education";

Part third of Article 256-7 to state 2) in the following edition:

"3. Pupils live and are brought up in orphanage of family type before achievement of 18-year age. After achievement of 18-year age such persons in case of continuation of training in organization of general average, professional (professional), professional prehigher or higher education can continue, at their choice, to live and be brought up in this orphanage of family type before the termination of such organization.

Persons from among the orphan children and children deprived of parent guardianship which establishes disability at their choice, can continue to live and be brought up in orphanage of family type before achievement of 23-year age by them irrespective of whether they study in organization of general average, professional (professional), professional prehigher, higher education".
