About modification of the Criminal Procedure Code of Ukraine concerning ensuring accomplishment of the solution of the Constitutional Court of Ukraine concerning appeal of determination of court about prolongation of term of detention

The Verkhovna Rada of Ukraine decides:

1. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88) the following changes:

Part one of Article 76 to add 1) with the words "except cases of review to them in appeal procedure for determination of Trial Court about election of measure of restraint in the form of detention, about change of other measure of restraint on measure of restraint in the form of detention or about prolongation of term of detention which was decided during judicial proceedings in Trial Court before adoption of the judgment in essence";

Article 331 to add 2) with part four of such content:

"4. The court order about election of measure of restraint in the form of detention, about change of other measure of restraint on measure of restraint in the form of detention or about prolongation of term of detention, taken out during judicial proceedings in Trial Court before adoption of the judgment in essence, can be appealed in appeal procedure.

Submission of the petition for appeal on the court order about election of measure of restraint in the form of detention, about change of other measure of restraint on measure of restraint in the form of detention or about prolongation of term of detention, taken out during judicial proceedings in Trial Court, does not stop legal proceedings in Trial Court";

Part the second Article 392 to add 3) with the paragraph the second such content:
