About introduction of amendments to some acts of the President of the Russian Federation concerning military and technical cooperation of the Russian Federation with foreign states

For the purpose of further enhancement of state regulation in the field of military and technical cooperation of the Russian Federation with foreign states I decide:

1. Bring in the Regulations on Federal Service for Military-Technical Cooperation approved by the Presidential decree of the Russian Federation of August 16, 2004 No. 1083 "Questions of Federal Service for Military-Technical Cooperation" (The Russian Federation Code, 2004, No. 34, Art. 3539; No. 43, Art. 4189; 2005, No. 13, Art. 1137; 2008, No. 49, Art. 5764; No. 50, Art. 5901; 2009, No. 1, Art. 93; 2011, No. 3, Art. 523; No. 21, Art. 2925; No. 31, Art. 4708; 2012, No. 38, Art. 5071; 2015, No. 4, Art. 641; 2016, No. 1, Art. 211; No. 35, Art. 5304; No. 50, Art. 7076; 2018, to No. 27, the Art. 4051), change, having stated the paragraph the fourth the subitem 2 of Item 9 in the following edition:

"about provision in accordance with the established procedure under authorization of the President of the Russian Federation to the organizations - developers and producers of military products and the managing companies of the integrated structures meeting the requirements, the established Federal Law of July 19, 1998 No. 114-FZ "About military and technical cooperation of the Russian Federation with foreign states", the rights to implementation of foreign trade activity concerning military products in the part concerning spare parts supplies, aggregates, nodes, devices, components, special, educational and auxiliary property, technical documentation to earlier delivered military products, works on survey, calibration, prolongation of useful life, maintenance, repair (including with the upgrade assuming carrying out research and development works), utilization and other works providing complex field service of earlier delivered military products, training of foreign specialists in carrying out the specified works, the participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair, destruction (utilization) of military products and production of the spare parts, aggregates, nodes, devices and components necessary for performance of works, providing complex field service of earlier delivered military products, rendering technical assistance in creation and additional equipment in the territories of foreign states of the special objects providing complex field service of earlier delivered military products and production of the spare parts, aggregates, nodes, devices and components necessary for such servicing import of the military products necessary for production of own military products, and also for use in case of production of own military products by the organizations - developers and producers of military products whose shares (share) are in the authorized capital of managing companies of the integrated structures (their subsidiaries) having opportunity to determine the decisions made by the organizations - developers and producers of military products; about deprivation in accordance with the established procedure the called organizations of the specified right;".

a) to add the subitem "b" of Item 2 of the Regulations on procedure of military and technical cooperation of the Russian Federation with foreign states with the paragraph of the following content:

"transfer of the military products included in the list No. 1, to the Russian organizations - to developers and producers of military products for the purpose of work and rendering services in the territory of the Russian Federation for the benefit of the foreign states included in the list No. 2, if transfer of such products is performed from availability of federal executive bodies;";

b) in Regulations on procedure for provision to the Russian organizations of the right to implementation of foreign trade activity concerning military products:

in Item 2:

state the subitem "v" in the following edition:

"c) the organizations - the developers and producers of military products which are meeting the requirements, the established Federal Law "About Military and Technical Cooperation of the Russian Federation with Foreign States", acquired in accordance with the established procedure the right to implementation of foreign trade activity concerning military products - in the part concerning spare parts supplies, aggregates, nodes, devices, components, special, educational and auxiliary property, technical documentation to earlier delivered military products; works on survey, calibration, prolongation of useful life, maintenance, repair (including with the upgrade assuming carrying out research and development works), utilization and other works providing complex field service of earlier delivered military products; training of foreign specialists in carrying out the specified works; participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair, destruction (utilization) of military products and production of the spare parts, aggregates, nodes, devices and components necessary for performance of works providing complex field service of earlier delivered military products; rendering technical assistance in creation and additional equipment in the territories of foreign states of the special objects providing complex field service of earlier delivered military products and production of the spare parts, aggregates, nodes, devices and components necessary for such servicing, import of the military products necessary for production of own military products. Other can be provided by the decision of the President of the Russian Federation or the international treaty of the Russian Federation;";

state the subitem "g" in the following edition:

"d) the managing companies of the integrated structures which are meeting the requirements, the established Federal Law "About Military and Technical Cooperation of the Russian Federation with Foreign States", acquired in accordance with the established procedure the right to implementation of foreign trade activity concerning military products - in the part concerning spare parts supplies, aggregates, nodes, devices, components, special, educational and auxiliary property, technical documentation to earlier delivered military products; works on survey, calibration, prolongation of useful life, maintenance, repair (including with the upgrade assuming carrying out research and development works), utilization and other works providing complex field service of earlier delivered military products; training of foreign specialists in carrying out the specified works; participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair, destruction (utilization) of military products and production of the spare parts, aggregates, nodes, devices and components necessary for performance of works providing complex field service of earlier delivered military products; rendering technical assistance in creation and additional equipment in the territories of foreign states of the special objects providing complex field service of earlier delivered military products and production of the spare parts, aggregates, nodes, devices and components necessary for such servicing, and also import of military products for its use in case of production of own military products by the organizations - developers and producers of military products whose shares (share) are in the authorized capital of managing companies of the integrated structures (their subsidiaries) having opportunity to determine the decisions made by the organizations - developers and producers of military products (further - the organizations of managing companies). Other can be provided by the decision of the President of the Russian Federation or the international treaty of the Russian Federation.";

the fifth Item 5 to state the paragraph in the following edition:

"By provision of the organization of the right to implementation of foreign trade activity concerning military products in the part concerning participation in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair, destruction (utilization) of military products and production of the spare parts, aggregates, nodes, devices and components necessary for performance of works providing complex field service of earlier delivered military products; rendering technical assistance in creation and additional equipment in the territories of foreign states of the special objects providing complex field service of earlier delivered military products and production of the spare parts, aggregates, nodes, devices and components necessary for such servicing; import of the military products necessary for production of own military products by the organization - developer and producer of military products, and also for use in case of production of own military products by the organizations of managing company, the decision is made proceeding from subject of productive activity of the organization - developer and the producer of military products and (or) the organizations of managing company.";

c) to add the subitem "i" of Item of 1 appendix to the Decree after words of "foreign states" with the word of "special".

Bring in the Presidential decree of the Russian Federation of January 18, 2007 No. 54 "About some questions of military and technical cooperation of the Russian Federation with foreign states" (The Russian Federation Code, 2007, No. 4, Art. 492; No. 52, Art. 6425; 2009, No. 42, Art. 4917; 2012, No. 3, Art. 405; 2013, No. 6, Art. 498; 2014, No. 46, Art. 6332; 2016, to No. 35, the Art. 5304) change, having stated the paragraph the fourth Item 1 in the following edition:

Other can be provided by the decision of the President of the Russian Federation or the international treaty of the Russian Federation.".

4. Bring in Item 1 of the Presidential decree of the Russian Federation of December 17, 2007 No. 1702 "About some questions of military and technical cooperation of the Russian Federation with the foreign states and of change and recognition which voided separate acts of the President of the Russian Federation" (The Russian Federation Code, 2007, No. 52, Art. 6425; 2012, No. 3, Art. 405; 2013, No. 6, Art. 498) following changes:

a) state the subitem "g" in the following edition:

"d) participations in creation of the companies (organizations), joint with foreign customers, which are engaged in maintenance, repair, destruction (utilization) of military products and production of the spare parts, aggregates, nodes, devices and components necessary for performance of works providing complex field service of earlier delivered military products;";

b) state the subitem "d" in the following edition:

"e) rendering technical assistance in creation and additional equipment in the territories of foreign states of the special objects providing complex field service of earlier delivered military products and production of the spare parts, aggregates, nodes, devices and components necessary for such servicing;".

5. This Decree becomes effective from the date of its signing.
