About introduction of amendments and changes in the Code of penal procedure of the Republic of Armenia

Article 1. To add part 1 of Article 6 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) with Item 49 of the following content:

"49) the agenda - the paper or electronic document which the body performing criminal proceedings invites person to participate in investigative or other legal proceeding or in judicial session.".

Article 2. Add the code with Chapter 24.1 of the following content:

"Chapter 24.1. Notifications

Article 174.1. Notification methods

1. The body performing criminal proceedings shall report properly on investigative or other legal proceeding or judicial session on persons who have the right or obligation to participate in them.

2. The notification of person is performed:

1) paper agenda;

2) electronic agenda;

3) by the announcement of the notification during the investigative or other legal proceeding or judicial session held with participation of the notified person, with simultaneous introduction of mark on it in the relevant protocol.

Article 174.2. Features of the notification of persons of separate categories

1. The minor is notified by means of the legal representative, and in case of stay in special facility - by means of its administration.

2. Person containing in the place of detention is notified by means of administration of the appropriate place.

3. The serviceman is notified by means of command of military unit.

Article 174.3. Contents of the agenda

1. In the agenda are specified:

1) data of the inviting body or the official;

2) name, surname, the address and the procedural status of the invited person;

3) place and time (year, month, day and hour) of appearance;

4) the investigative or other legal proceeding which is subject to carrying out;

5) the fact which is been the basis for the brought criminal case and its legal treatment;
