I ORDER:

1. Bring in the order of the Minister of the Industry and infrastructure development of the Republic of Kazakhstan of March 30, 2019 No. 171 "About approval of rules of forming of rates" (it is registered in the Register of state registration of regulatory legal acts at No. 18470, it is published on April 12, 2019 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in electronic form) the following changes:

state Item 76 in the following edition:

"76. The temporary compensating rate affirms taking into account base rate of National Bank of the Republic of Kazakhstan on the date of decision making.";

state Item 83 in the following edition:

"83. During action of the temporary compensating rate the subject of natural monopoly can address to authorized body with the request for approval of rate or its limit according to the Law.

At the same time the income accepted in reasons for level of new rate decreases by the amount of unreasonably gained income taking into account base rate of National Bank of the Republic of Kazakhstan on the date of decision making minus already compensated by the subject of natural monopoly to consumers of its regulated services.

At the same time, separately in the tariff estimate the amount of non-execution of the tariff estimate and (or) investing program is specified.

By consideration of the request of the subject of natural monopoly by authorized body for approval of new rate or their limits, authorized body in case of identification of the amount of the unreasonable income taking into account base rate of National Bank of the Republic of Kazakhstan, excludes it from the income accepted in reasons for level of new rate or their limits.";
