About introduction of amendments to article 12 of the Law of Ukraine "About providing the rights and freedoms of citizens and legal regime in temporarily occupied territory of Ukraine" concerning establishment of alternative cognizance of cases which participants constantly live in temporarily occupied territory of the Autonomous Republic of Crimea and the city of Sevastopol

The Verkhovna Rada of Ukraine decides:

I. "About providing the rights and freedoms of citizens and legal regime in temporarily occupied territory of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 2014, No. 26, Art. 892 with subsequent changes) after the paragraph of the tenth to add part one of article 12 of the Law of Ukraine with three new paragraphs of the following content:

"In civil cases, cognizable to the local general courts located in the territory of the Autonomous Republic of Crimea and the city of Sevastopol, actions for declaration, statements for issue of the writ, the statement for special proceeding can be shown by also physical person which constantly lives in temporarily occupied territory, in the local general court located within the Kherson region at the choice of person.

After opening of production in civil cases, cognizable in fact the physical person (the defendant, the debtor, the interested person, the third party) which constantly lives in temporarily occupied territory can submit to the local general courts located in the territory of the Autonomous Republic of Crimea and the city of Sevastopol until consideration of the case the petition to certain local general vessels of the city of Kiev in which production there is case, about transfer of such case to the local general court located within the Kherson region at the choice of person. In case of submission of such petition the case can be submitted to the local general court determined by person located within the Kherson region based on the court order no later than five days after the termination of term on its appeal, and in case of submission of the claim - no later than five days after its leaving without satisfaction. Repeated case referral is not allowed.
