About introduction of amendments and changes in the Law "About Operational Search Activities"

Article 1. No. ZR-223 "About operational search activities" (further - the Law) to add part 1 of article 4 of the Law of October 22, 2007 with Item 17 of the following content:

"17) prevention or exposure of offenses in the field of protection of the economic competition: anti-competitive agreements, abuse of monopoly or dominant position or the prohibited coordination of economic activity - according to the motivated petition of the Commission on protection of the competition or in the cases established by the law.".

Article 2. To add article 6 of the Law with part 5 of the following content:

"5. Transfer by the bodies performing operational search activities, results of investigation and search operations on offenses in the field of protection of the economic competition, including data materials and documents in the Commission on protection of the competition are not their disclosure.".

Article 3. Regarding 1 article 10 of the Law of the word "the tasks established by this Law" shall be replaced with words "their tasks, including prevention or exposure of offenses in the field of protection of the economic competition: anti-competitive agreements, abuse of monopoly or dominant position or coordination of economic activity,".

Article 4. To add part 1 of article 11 of the Law with Item 5 of the following content:

"5) in case of impossibility of direct acquisition by the Commission on protection of the competition of necessary data based on the motivated decision of the Commission on protection of the competition to assist the last in prevention or disclosure of offenses in the field of protection of the economic competition, performing the actions established by part of 1 Article 10, investigation and search operations, established by Items 7, of 8, 11 and 12 parts 1 of article 14 of this Law and reporting their results, including data, materials and documents of the Commission on protection of the competition.".
