About modification of some legislative acts of Ukraine concerning certification of the operator of system of transfer

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Economic code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 18-22, 144):

Part the sixth Article 136 to state 1) in the following edition:

"6. The authorized subject of management of objects of state-owned property which are used in the course of implementation of activities for transportation and/or storage of natural gas and also the subject of management of system of transfer of electrical energy cannot refuse financing respectively by the operator of system of transfer or the operator of gas-transport system, or other interested person of the investments approved with the National commission performing state regulation in spheres of power and utilities. In case of approval of such investments the National commission performing state regulation in spheres of power and utilities is guided, in particular, by need of safety of supply of natural gas, transfer of electrical energy, operational safety of the Integrated power system of Ukraine";

Part the eighth Article 141 to state 2) in the following edition:

"8. The objects of state-owned property used in the course of implementation of activities for transfer of electrical energy and transportation and/or storage of natural gas based on the solution of subject of management and the relevant agreement are assigned on the right of economic maintaining to subjects of managing in which authorized capital 100 percent of corporate laws belong to the state, or subject of managing in which authorized capital 100 percent of corporate laws belong to the state, or is exclusive for the purpose of department of activities for transportation of natural gas behind subject of managing in which authorized capital 100 percent belong to the subjects specified in this part".
