Article 1. To state Article 152 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) in the following edition:

"Article 152. Suspension of powers of the worker having the status of the suspect or person accused

1. During pre-judicial criminal proceeding the prosecutor or, with the consent of the prosecutor - the investigator, and by consideration of criminal case in court - according to the petition of the party of accusation or on own initiative powers of the worker having the status of the suspect or person accused, including person which is on public service can suspend court if there are good causes to believe that, performing labor powers, it will interfere with investigation of case, compensation of the damage caused by crime or will make the act which is not permitted by the penal statute. The decision on suspension of powers made by the prosecutor or, with the consent of the prosecutor - the investigator during pre-judicial criminal proceeding in three-day time is submitted for approval of court.

2. Powers of the worker having the status of the suspect or person accused are considered suspended from the moment of decision making about suspension of powers. The body performing production hands the decision on suspension of powers on receipt to the suspect or the person accused and immediately sends to place of employment of the suspect or person accused.

3. The decision on suspension of powers is cancelled by the judgment, and during pre-judicial criminal proceeding - also the prosecutor when need for it disappears. The body performing production after its cancellation immediately sends the decision on suspension of powers to place of employment of the suspect or person accused.".

Article 2. Article 280 of the Code after words "arrest applications as measure of restraint," to add with the words "confirmation of legitimacy of the decision on suspension of powers of the worker having the status of the suspect or person accused".
