About modification of the Civil code of the Republic of Armenia
Accepted by National Assembly of the Republic of Armenia on March 3, 2021
Article 1. In the Civil code of the Republic of Armenia of May 5, 1998 (further - the Code):
1) from all text of the word "useful models" to exclude;
2) in all text of the word "industrial design" in the corresponding case forms shall be replaced with words "industrial design".
Article 2. In all text of Chapter 65 of the Code of the word "The Law of the Republic of Armenia " about Inventions, Useful Models, Industrial Designs "" shall be replaced with words "laws "About Patents" and "About Industrial Design"".
Article 3. Regarding the 2nd article 1144 of the Code:
Item 2 to state 1) in the following edition:
"2) to the new, not following directly from equipment level invention;";
Item 3 to state 2) in the following edition:
"3) to the new and original industrial design characterizing appearance of products.".
Article 4. To state article 1148 of the Code in the following edition:
"Article 1148. Coauthors of the invention, industrial design
1. Relations of coauthors of the invention, industrial design are established by the agreement signed between them. In the absence of the agreement or if the relations are not governed by the agreement, the arisen disputes are resolved judicially.
2. Assistance of not creative nature rendered creation of the invention, industrial design (technical, organizing or financial support, assistance in registration of the rights and other) does not lead to co-authorship.".
Article 5. To state article 1149 of the Code in the following edition:
"Article 1149. Employee inventions, office industrial designs
1. The right to the invention, the industrial design created by the worker on duty or tasks of the employer (the employee invention, office industrial design), belongs to the employer if other is not provided by the agreement signed between them.".
