About modification of the Operations procedure of authorized officers of bodies of the State Border Service of Ukraine during detention of persons suspected of crime execution without determination of the investigative judge or court

According to the paragraph of Item 2 of the Section II "Final provisions" of the Law of Ukraine of June 4, 2020 No. 671-IX "About modification of some legal acts of Ukraine concerning responsibility for the crimes committed by criminal society" and for the purpose of reduction of regulatory legal acts of the Ministry of Internal Affairs of Ukraine in compliance with the legislation I ORDER the fourth:

1. Bring in the Operations procedure of authorized officers of bodies of the State Border Service of Ukraine during detention of persons suspected of crime execution, without determination of the investigative judge or court, No. approved by the order of the Ministry of Internal Affairs of Ukraine of May 10, 2018 386, registered in the Ministry of Justice of Ukraine on July 18, 2018 for No. 834/32286, the following changes:

Item 2 of the Section I to state 1) in the following edition:

"2. In this Procedure the term "authorized officer" means the serviceman of body of State frontier service who directly carries out tasks on operational and service activity of State frontier service";

Item 1 of the Section II after the paragraph of the fourth to add 2) with the new paragraph the fifth the following content:

"there are reasonable bases to believe that flight for the purpose of evasion from criminal liability of the person suspected of crime execution, provided by Articles 255, 255-1, 255-2 Criminal codes of Ukraine is possible.".
