About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In the Law on the state control of business activity No. 131/2012 (Official monitor of the Republic of Moldova, 2012, Art. No. 181-184, 595), with subsequent changes, to make the following changes:

1. Add the law with Article 3-2 of the following content:

"Article 3-2. The prevention of violation of the law and consultation of person which is subject to control

(1) For the purpose of the correct and uniform application of provisions of the legislation monitoring bodies shall give advisory support to the physical persons and legal entities performing business activity.

(2) For the purpose of realization of consulting function monitoring bodies:

a) develop and publish on the official web pages the procedures for rendering advisory support and control procedure used by all persons, competent for control;

b) publish on the official web pages the most often found cases, the established typical violations, and also the recommendations issued in such cases and instructions;

c) develop and publish on the official web pages the documents and managements intended for informing on the rights and obligations of monitoring bodies, the rights and obligations of persons which are subject to control, on the relevant current legislation with indication of at the same time possible violations allowed by persons which are subject to control, the acts constituting offenses, the corresponding sanctions and other applicable measures for each monitoring body;

d) actively carry out the advising role during each control in order to avoid violation of provisions of the legislation.

(3) the Body of the central public management responsible for supervision over control, publishes on the web page of the State register of control provided in part (2) the documents developed by monitoring bodies.".

2. Add Article 8 with part (4) the following content:
