About entering of amendments into the Labor code of the Republic of Armenia

Accepted by National Assembly of the Republic of Armenia on March 25, 2021

Article 1. To add the labor code of the Republic of Armenia of November 9, 2004 (further - the Code) with Articles 108.1 and 108.2 of the following content:

"Article 108.1. Consequence in law of suspension of powers of the worker

1. From the moment of suspension of powers of the worker having the status of the suspect or person accused, including person which is on public service, according to the procedure, stipulated in Clause 152 Codes of penal procedure of the Republic of Armenia before cancellation of the decision on suspension its workplace (position) remains, and in the case with person which is on public service also monthly compensation in the amount of fifty percent of base pay is paid, but the nominal size of the minimum monthly salary established by the law, with performing payment of other part in case of the end of criminal case based on justification suffices.

2. During suspension of powers of the worker having the status of the suspect or person accused he cannot exercise the right to annual leave.

3. Suspension of powers is not obstacle for termination of the employment contract if for the period suspensions there was one of the bases for termination of the employment contract provided by the law.

4. In case with person which is on public service, part of 1 this Article is applied if other is not provided by the industry laws.

Article 108.2. Arrest application consequence in law as measures of restraint concerning the worker

1. From the moment of application concerning the worker, including person which is on public service of arrest as measure of restraint before its replacement with other measure of restraint or cancellations of power of the worker are considered as suspended.

2. During stay under arrest the workplace (position) of the worker remains. During stay under arrest the salary of person which is on public service does not remain.

3. During stay under arrest the worker cannot exercise the right to annual leave.
