About modification of the Criminal Procedure Code of Ukraine concerning implementation of information and telecommunication system of pre-judicial investigation

The Verkhovna Rada of Ukraine decides:

I. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88) the following changes:

1. Add with Article 106-1 of the following content:

"Article 106-1. Information and telecommunication system of pre-judicial investigation

1. The information and telecommunication system of pre-judicial investigation is system which provides creation, collection, storage, search, processing and transfer of materials and information (data) in criminal proceedings.

The procedure for functioning of information and telecommunication system of pre-judicial investigation is determined by the provision approved jointly by Office of the Attorney-General, body as a part of which the body of pre-judicial investigation, and also body which approves regulations on system which functions in court according to article 35 of this Code functions.

The information and telecommunication system of pre-judicial investigation interacts with the Unified register of pre-judicial investigations and system which functions in court according to article 35 of this Code, and also can interact with other information, information and telecommunication systems in the cases provided by the law.

2. The investigator, the investigator, the prosecutor, the investigative judge, court, and also the defender (in its consent) use, and other participants of criminal proceedings can use information and telecommunication system of pre-judicial investigation during realization of the powers, the rights and interests provided by this Code under conditions and according to the procedure which are determined by regulations on such system.

In case of use the research of the materials of pre-judicial investigation which are available in this system specified in this Article of system can be performed with use of access to them through this system.
