About introduction of amendments to the Law of the Kyrgyz Republic "About subsoil"

Bring in the Law of the Kyrgyz Republic "About subsoil" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2018, No. 5, the Art. 282) the following changes:
Item 41 of Article 4 to state 1) in the following edition:
"41) development of minerals - works on mineral deposits on collection, extraction of minerals from subsoil, their conversion (including selection of underground waters), and also on conversion of technogenic educations;";

3) in Article 35:
a) Item 2 parts 1 after words of "minerals" to add with words "(except for developments of technogenic educations)";
b) in part 2:
- "property on" to add part after words with the word "taken";
- add part with the paragraph the second the following content:
"The minerals containing in technogenic educations are property of the Kyrgyz Republic and the Cabinet of Ministers of the Kyrgyz Republic has the privilege on secondary conversion of technogenic educations.";
To state 4) to part 9-12 of Article 49 in the following edition:
"9. Guarantee of carrying out recultivation works is forming by the subsoil user of fund of recultivation.
10. The procedure for carrying out recultivation works, their acceptance, and also forming of fund of recultivation is determined by the Cabinet of Ministers of the Kyrgyz Republic.
11. Fund of recultivation is accumulated in the banks determined by the Cabinet of Ministers of the Kyrgyz Republic and can be used by banks on returnable basis for the purposes of development of economy of the Kyrgyz Republic via instruments of crediting and investment.
Fund of recultivation cannot be spent and used by the subsoil user or owners of land entitlements on other purposes, including for satisfaction of requirements of creditors and debt repayment on tax and customs payments.
