For the purpose of protection of national interests and ensuring accomplishment of the international obligations of the Russian Federation on non-proliferation of nuclear weapon I decide:
1. Enter in the List of the nuclear materials, the equipment, special non-nuclear materials and appropriate technologies falling under the export control approved by the Presidential decree of the Russian Federation of February 14, 1996 No. 202 "About approval of the List of the nuclear materials, the equipment, special non-nuclear materials and appropriate technologies falling under export control" (The Russian Federation Code, 1996, No. 8, Art. 742; 1997, No. 4, Art. 523; No. 20, Art. 2234; 2000, No. 19, Art. 2062; No. 26, Art. 2749; 2004, No. 6, Art. 411; 2005, No. 47, Art. 4879; 2008, No. 42, Art. 4787; 2014, No. 36, Art. 4827; 2017, No. 47, the Art. 6961), changes according to the list according to appendix No. 1.
2. Enter in the List of the equipment and the materials of dual purpose and appropriate technologies applied in the nuclear purposes concerning which the export control approved by the Presidential decree of the Russian Federation of January 14, 2003 No. 36 "About the approval of the List of the equipment and materials of dual purpose and appropriate technologies applied in the nuclear purposes concerning which export control" (The Russian Federation Code, 2003, No. 3, Art. 208 is exercised is exercised; 2006, No. 42, Art. 4349; 2008, No. 42, Art. 4787; 2014, No. 36, Art. 4827; 2017, No. 47, the Art. 6961), changes according to the list according to appendix No. 2.

Appendix №1
to the Presidential decree of the Russian Federation of January 22, 2021 No. 42
1. In the note to Items 1.3.1 - 1.3.4 Sections 1 of the word" (" shall be replaced with words NP-053-04) "(NP-053-16)".
2. In Section 2:
to add the explanatory note to Item 2.2.2 with the paragraph of the following content:
"Action of this Item does not extend to the graphite having purity degree on boric equivalent it is higher than 5 million shares, with density it is more, than 1,50 of / cubic cm, not held for use in nuclear reactors as they are determined in Item 2.1.1.";
to add paragraph two of introduction notes to Item 2.3 after the words "are similar and include:" with the words "opening of covers";
to it to state Item 2.3.2.1 and the explanatory note in the following edition:
|
"2.3.2.1. |
The equipment for opening of covers and the machine for crushing of the irradiated fuel elements Specially developed or prepared remotely-controlled equipment used in installations on conversion as they are determined in Item 2.3. 1, and intended for extraction from cover or preparation for conversion of the irradiated nuclear material which is in fuel assemblies, bunches or cores |
8456; 8462 31 000; 8462 39 990 0; 8479 82 000 0; 8479 89 970 8 |
|
Explanatory note. This equipment is used for cutting, the cabin or opening by any other method of cover of the irradiated nuclear fuel for the purpose of its conversion or preparation for conversion. The devices which are specially developed for cutting are usually used though also more modern equipment, such as the lasers, devices for flaking of cover or the device using other technologies can be used. Opening of cover can also include removal of cover of the irradiated nuclear fuel before its dissolution."; | ||
to it to state Item 2.3.2.2 and the explanatory note in the following edition:
|
"2.3.2.2. |
Dissolvera Specially developed or prepared cases of dissolver, and also mechanical devices which are built in in dissolver used in installations on conversion as they are determined in Item 2.3. 1, for dissolution of the irradiated nuclear fuel which are steady against impact of hot high-corrosion liquid and can remotely be loaded, be controlled and be serviced |
7309 00 300 0; 7309 00 900 0; 8479 89 970 8 |
Explanatory note. In dissolver the solid irradiated nuclear fuel usually arrives. Nuclear fuel in covers from zirconium, stainless steels or alloys of these materials shall be opened, cut or cut before being loaded in dissolver in order that acid reached fuel matrix. The irradiated nuclear fuel usually is dissolved by means of strong inorganic acids, for example nitric acid, and all not dissolved remaining balance of covers is removed. Such design features as small diameter, ring-shaped or flat tank applied to ensuring nuclear safety from the point of view of achievement of criticality are not obligatory. Instead organizational and technical actions, such as reduction of one-time loading or decrease in content of the sharing materials can be used. Cases of dissolver and mechanical devices which are built in them usually are manufactured of low-carbon stainless steels, titanium, zirconium or other high-quality materials. Dissolvera can include systems for removal of covers or their remaining balance, and also systems for control and processing of the radioactive coming-out gases. Such dissolver differ in the fact that are usually established, operated and are remotely serviced behind thick-walled radiation protection.".
3. In the Section "Determinations of Terms (in relation to This List)":
to state the note to Item 1 in the following edition:
"Note. This determination of technology does not extend to the technology which is "in public property", or "basic scientific research", and also to information minimum necessary for execution of the patent request.";
state Item 3 in the following edition:
"3. "Specifications" can be provided in such forms as:
drawings or their copies;
schemes;
charts;
models;
formulas;
engineering designs and specifications;
reference materials;
managements and instructions.
"Specifications" can be provided (are fixed) on papers or fixed on any other material carriers or placed in the remote (distributed) devices of storage of information.";
state item 4 in the following edition:
"4. "In public property" means the technology or the software provided without restrictions for their further distribution. (The restrictions connected with copyright do not exclude technology or the software from the category being in public property.)".

The import permit of the software, except for the source code, also belongs to the software intended for correction of defects (mistakes) in the software delivered earlier together with the exported subject provided that at the same time opportunities or work characteristics of subject will not improve.";
state Item 10 in the following edition:
"10. Export control does not extend:
on the technology which is in public property or relating to basic scientific research;
