About introduction of amendments to the Law on legal profession No. 1260/2002

The Parliament adopts this organic law.

Art. I. - In the Law on legal profession No. 1260/2002 (repeated publication: The official monitor of the Republic of Moldova, 2010, No. 159, of the Art. 582), with subsequent changes to make the following changes:

1. In Article 4:

consider single part part (1);

add Article with part (2) the following content:

"(2) the Charter of lawyer profession and the changes made to it are published in the Official monitor of the Republic of Moldova.".

2. Part (Article 8 to add 1) with Item g) the following content:

"g) perform activities for independent investigation.".

3. Part (Article 10 to state 2) in the following edition:

"(2) the following persons Are exempted from passing of professional training and passing qualification examination:

a) owners of degree of the doctor juris;

b) persons having at least ten-year length of service in judgeships or the prosecutor if within six months after resignation from the corresponding position they submitted the application for issue to them of the license for occupation lawyer activities;

c) persons having at least ten-year length of service in judgeship or the prosecutor and after resignation from judgeship or the prosecutor continued to work in the field of the right if within six months after resignation from the position held in area of the right they submitted the application for issue to them of the license for occupation lawyer activities;

d) persons having at least six-year years of service of continuous work in judgeships or the prosecutor - graduates of rates of basic training of judges or prosecutors at National institute of justice.".

4. State Article 11 in the following edition:

"Article 11. Incompatibility

(1) Lawyer activities are incompatible:

a) with occupation of any state or responsible state position;

b) with notarial activities and activities of the legal executive;

c) with other activities causing damage to prestige or independence of lawyer activities or to moral standards.
