About modification of the Section X "Final and transitional provisions" of the Law of Ukraine "About public purchases" concerning exception of possibility of implementation of purchases without use of electronic purchasing system

The Verkhovna Rada of Ukraine decides:

I. Item 3-1 of the Section X "Final and transitional provisions" of the Law of Ukraine "About public purchases" (Sheets of the Verkhovna Rada of Ukraine, 2019, No. 45, Art. 289; 2020, 16, 100, No. 18, the Art. 123) to state No. to the Art. in the following edition:

"3-1. Determine that for action of the quarantine established by the Cabinet of Ministers of Ukraine, according to the Law of Ukraine "About protection of the population against infectious diseases", operation of this Law does not extend to cases if subject of purchase are medicines, vaccines or other medical immunobiological supplies, consumable materials for delivery of health care by sick COVID-19 and medical products for vaccination from COVID-19, the medical equipment for the healthcare institutions giving help to patients, sick COVID-19, of system of supply of the medical gases necessary for accomplishment of the actions directed to prevention of origin and distribution, localization and liquidation of flashes, epidemics and pandemics of koronavirusny disease (COVID-19). The list of such medicines and procedure for their purchase affirm the Cabinet of Ministers of Ukraine.

By results of such purchase the customer publishes the report on the purchase agreement signed without use of electronic purchasing system, the purchase agreement and all appendices to it, the report on agreement performance on purchase according to article 10 of this Law in electronic purchasing system.

In case of non-compliance with requirements for the publication of such reports perpetrators are made responsible according to the law.
