About introduction of amendments to article 51 of the Maritime Code of Ukraine concerning requirements to qualification of crew members

The Verkhovna Rada of Ukraine decides:

I. The text of Article 51 of the Maritime Code of Ukraine (1995, 349) to state sheets of the Verkhovna Rada of Ukraine to Art. No. No. 47-52, in the following edition:

"Persons who have the corresponding ranks are allowed to holding the posts of the captain and other faces of command structure of the vessel and had obligatory training on the conditions determined by the International convention about preparation and certification of seamen and execution of watch of 1978 with amendments.

Regulations on ranks of faces of command structure of ocean ships and procedure for their assignment affirm the Cabinet of Ministers of Ukraine.

Assignment of ranks makes sure issue of the diploma (the certificate of competence) and confirmation to it after successful confirmation of competence of the state qualification commission.

Obligatory training of seamen for persons who hold certain positions on the vessel or fulfill special duties on the vessel, it is performed according to the programs of preparation approved by the federal executive body realizing state policy in the field of sea and river transport and is confirmed by receipt of the specialist by person of the Certificate after successful completion of the approved program of preparation and, in case of need, confirmation of qualification in the state qualification commission.

Repeated confirmation of the diploma is performed through the term which is not exceeding five years from date of issue of the previous confirmation without examination in the state qualification commission in case of observance of the following requirements:

1) suitability of person for work in courts for health reasons;

2) availability of the existing certificates on the approved obligatory preparation necessary for the diploma which proves to be true;
