About introduction of amendments to the Law of the Kyrgyz Republic "About subsoil"

Accepted by Jogorku Kenesh of the Kyrgyz Republic on July 22, 2021

Article 1.

Bring in the Law of the Kyrgyz Republic "About subsoil" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2018, No. 5, the Art. 282) the following changes:

1) in all text of the Law the word "Government" in different case forms shall be replaced with words "Cabinet of Ministers" in the corresponding cases;

2) in Article 22:

a) state part 1 in the following edition:

"1. The mineral right can be granted in the way:

1) carrying out tender;

2) holding the auction;

3) applications of the rule of "the first submitted application";

4) decision makings of the Kyrgyz Republic by the Cabinet of Ministers.";

b) recognize part 8 invalid;

3) part 3 of Article 25 to recognize invalid;

The Law to add 4) with Article 25-1 of the following content:

"Article 25-1. Procedure for provision of mineral right based on the decision of the Cabinet of Ministers of the Kyrgyz Republic

1. The mineral right according to the decision of the Cabinet of Ministers of the Kyrgyz Republic is granted only to business entities and the state companies with 100 percent state share.

Acceptance by the Cabinet of Ministers of the Kyrgyz Republic of the decision on provision of mineral right excludes need of carrying out tender or auction.

2. The procedure for provision of mineral right is determined by the decision of the Cabinet of Ministers of the Kyrgyz Republic by the Cabinet of Ministers of the Kyrgyz Republic.".

Article 2.

This Law becomes effective after seven days from the date of official publication.
