About introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation.

2. This resolution becomes effective from the date of its official publication and is not applied to the relations connected with implementation of purchases, notices on which implementation are placed in unified information system in the field of purchases and invitations to take part in which are sent about day of entry into force of this resolution, including to contracts, information on which is included in the register of the contracts signed by customers about day of entry into force of this resolution.

1. In the list of separate types of the medical products coming from foreign states concerning which restrictions of the admission for the purposes of implementation of purchases for ensuring the state and municipal needs, No. 102 approved by the order of the Government of the Russian Federation of February 5, 2015 "About restrictions and conditions of the admission of separate types of the medical products coming from foreign states for the purposes of implementation of purchases for ensuring the state and municipal needs" (The Russian Federation Code, 2015, No. 6, Art. 979 are set; 2019, No. 27, Art. 3578; 2020, No. 27, Art. 4245; 2021, No. 11, Art. 1828):

2. The subitem "an" of Item 5 of Rules of use of the catalog of goods, works, services for ensuring the state and municipal needs approved by the order of the Government of the Russian Federation of February 8, 2017 No. 145 "About approval of Rules of forming and maintaining in unified information system in the field of purchases of the catalog of goods, works, services for ensuring the state and municipal needs and Rules of use of the catalog of goods, works, services for ensuring the state and municipal needs" (The Russian Federation Code, 2017, No. 7, Art. 1084; 2020, No. 28, Art. 4421; No. 49, of the Art. 7898) to state in the following edition:

"a) implementation of purchase of the radio-electronic products included in Items 25 (1) - 25(7) lists of the manufactured goods coming from foreign states (except for state members of the Eurasian Economic Union) concerning which the prohibition on the admission for the purposes of the implementation of purchases for the state and municipal needs provided by appendix to the order of the Government of the Russian Federation of April 30, 2020 No. 616 "About establishment of prohibition on the admission of the manufactured goods coming from foreign states for the purposes of implementation of purchases for the state and municipal needs, and also manufactured goods coming from foreign states, works (services) performed (rendered) by foreign persons, for the purposes of implementation of purchases for needs of defense of the country and safety of the state" is established on condition of establishment according to the specified resolution of prohibition on the admission of the radio-electronic products coming from foreign states, and also implementation of purchase of the radio-electronic products included in the list of the radio-electronic products coming from foreign states concerning which restrictions for the purposes of implementation of purchases for ensuring the state and municipal needs, No. 878 approved by the order of the Government of the Russian Federation of July 10, 2019 "About measures of production incentive of radio-electronic products are set in the territory of the Russian Federation when implementing purchases of goods, works, services for ensuring the state and municipal needs, about modification of the order of the Government of the Russian Federation of September 16, 2016 No. 925 and recognition voided some acts of the Government of the Russian Federation" on condition of establishment according to the specified resolution of restriction for the admission of the radio-electronic products coming from foreign states;".

3. In the order of the Government of the Russian Federation of July 10, 2019 No. 878 "About measures of production incentive of radio-electronic products in the territory of the Russian Federation when implementing purchases of goods, works, services for ensuring the state and municipal needs, about modification of the order of the Government of the Russian Federation of September 16, 2016 No. 925 and recognition voided some acts of the Government of the Russian Federation" (The Russian Federation Code, 2019, No. 29, Art. 4023; No. 52, Art. 7983; 2020, No. 31, Art. 5192):

a) Items 3 - 4 to state in the following edition:

"3. Determine that when implementing purchases of the radio-electronic products included in the list, the customer rejects all requests (final offers) containing offers on delivery of the radio-electronic products coming from foreign states (except for state members of the Eurasian Economic Union) provided that on participation in purchase the request (final offer) meeting requirements of the notice on implementation of purchase and (or) documentation on purchase containing the offer on delivery of the radio-electronic products made in the territories of state members of the Eurasian Economic Union is submitted 1 (or more).

Confirmation of production of radio-electronic products is:

in the territory of the Russian Federation - availability of data on such products in the register;

in the territory of state member of the Eurasian Economic Union - availability of data on such products in the Eurasian register of manufactured goods of state members of the Eurasian Economic Union which forming and maintaining are established by the right of the Eurasian Economic Union (further - the Eurasian register of manufactured goods).

3(1). Determine that for confirmation of conformity of the delivered radio-electronic products to the requirements established by this resolution, the procurement participant specifies (declares) as a part of the application for participation in purchase:

concerning goods which country of source is the Russian Federation - numbers of register entries from the register, and also information on the cumulative number of points for accomplishment of technological transactions (conditions) in the territory of the Russian Federation if it is provided by the order of the Government of the Russian Federation of July 17, 2015 No. 719 "About confirmation of production of industrial output in the territory of the Russian Federation" (for products concerning which are established requirements about the cumulative number of points for accomplishment (development) in the territory of the Russian Federation of the conforming transactions (conditions) (further - the cumulative number of points). Information on register entries on goods joins in the contract;

concerning goods which country of source is the state member of the Eurasian Economic Union, except for the Russian Federation - numbers of register entries from the Eurasian register of manufactured goods, and also information on the cumulative number of points for accomplishment of technological transactions (conditions) in the territory of state member of the Eurasian Economic Union if it is provided by the decision of Council of the Eurasian economic commission of November 23, 2020 No. 105 "About approval of Rules of determination of country of source of separate types of goods for the purposes of the public (municipal) procurements" (for products concerning which are established requirements about the cumulative number of points for accomplishment (development) of the conforming transactions (conditions). Information on register entries on goods joins in the contract.

In case of representation by the procurement participant as a part of the request of information from the register or the Eurasian register of manufactured goods without specifying of cumulative number of points or with indication of the cumulative number of points established for the purposes of implementation of purchases by the order of the Government of the Russian Federation of July 17, 2015 No. 719 "About confirmation of production of industrial output in the territory of the Russian Federation", this resolution or the decision of Council of the Eurasian economic commission of November 23, 2020 No. 105 "About approval of Rules of determination of country of source of separate types of goods for the purposes of the public (municipal) procurements" respectively such request is equated to the request which contains the offer on delivery of the goods coming from foreign states.

Numbers of register entries from the register are not represented by the deliveries of arms, the military and special equipment taken advantage, supply to operation, and (or) by the deliveries of samples of arms, the military and special equipment developed according to design documentation with letter not below "O1". Information on such goods is not subject to inclusion in the register.

In case of execution of the contract the supplier (the contractor, the contractor) by transfer of goods (results of work) shall submit to the customer the documents confirming the country of goods' origin based on which inclusion of products in the register or the Eurasian register of manufactured goods is performed.

Submitting the application, the procurement participant agrees with condition about entering of data on such goods into the register or the Eurasian register of manufactured goods, and also about need to submit on the stages of execution of the contract of the data and documents specified in this Item.

4. Determine that restriction for the admission of the radio-electronic products coming from foreign states is not established if in the register and the register of Eurasian manufactured goods there are no radio-electronic products corresponding to the same class (functional purpose) of the radio-electronic products planned to purchase, and (or) the radio-electronic products included in the register or the register of Eurasian manufactured goods according to the functional, technical and (or) operational characteristics do not conform to the requirements to the radio-electronic products planned to purchase established by the customer.";

b) in Item 5 of the word "reasons for impossibility of observance of restriction for the admission of the radio-electronic products coming from foreign states, for the purposes of implementation of purchases for ensuring the state and municipal needs, prepared by the customer according to Procedure for preparation of reasons for impossibility of observance of restriction for the admission of the radio-electronic products coming from foreign states, for the purposes of implementation of purchases for ensuring the state and municipal needs, the approved this resolution, and placed by the customer in unified information system in the field of purchases along with placement of the notice on purchase implementation" shall be replaced with words "the procurement authorization of the industrial goods coming from foreign state issued according to the procedure, established by the Ministry of Industry and Trade of the Russian Federation";

c) to add Item 6 after the word "register" with the words "or register of Eurasian manufactured goods";

d) state Item 8 in the following edition:

"8. In case of execution of the contract replacement of the electronic products included in the list by electronic products, data on which are absent in the register or in the register of Eurasian manufactured goods, is not allowed.";

e) to declare the subitem "v" of Item 10 invalid;

e) in paragraph three of Item 13 of the word "also are effective within 2 years" to exclude;

g) Procedure for preparation of reasons for impossibility of observance of restriction for the admission of the radio-electronic products coming from foreign states, for the purposes of implementation of purchases for ensuring the state and municipal needs, approved by the specified resolution to declare invalid;

h) the list of the radio-electronic products coming from foreign states concerning which restrictions for the purposes of implementation of purchases for ensuring the state and municipal needs are set, approved by the specified resolution to state in the following edition:
