About modification and amendments in some legal acts of the Republic of Uzbekistan in connection with further enhancement of legal protection of intellectual property items

Article 1. In part three of Article 5 of the text in Uzbek of the Law of the Republic of Uzbekistan of May 6, 1994 No. 1062-XII "About inventions, useful models and industrial designs" (in edition of the Law of the Republic of Uzbekistan of August 29, 2002 No. 397-II) (Sheets of Oliy Majlis of the Republic of Uzbekistan, 2002, No. 9, Art. 158; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2008, No. 7, Art. 355; 2011, No. 12/2, of Art. 364; 2017, No. 6, Art. 300, No. 9, Art. 510; 2020, No. 1, Art. 1, No. 10, Art. 593; 2021, appendix to No. 4) of the word "patent of berilganligig of Qarshi эътироз билдириш" shall be replaced with words "the patent of berilganliga юзасидан низолашиш".

Article 3. Bring in the Law of the Republic of Uzbekistan of August 30, 2001 No. 267-II "About trademarks, service marks and names of places of goods origin" (Sheets of Oliy Majlis of the Republic of Uzbekistan, 2001, No. 9-10, of Art. 178; 2002, No. 9, Art. 165; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2007, No. 9, Art. 418; 2011, No. 12/2, of Art. 364; 2012, No. 12, Art. 336; 2017, No. 4, Art. 138, No. 9, Art. 510; 2020, No. 1, Art. 1, No. 10, Art. 593; 2021, appendix to No. 4) following amendments and changes:

1) in Article 8:

add with parts three and the fourth the following content:

"After application for registration of the trademark, the name of the place of goods origin and right to use by the name of the place of goods origin the Agency within one working day posts data on this request on the official website.

After placement of data on the request on the official website interested persons can represent to the Agency written notes on bad faith of the submitted application for registration of the trademark, the name of the place of goods origin and right to use by the name of the place of goods origin";

speak rapidly the third, fourth and fifth to consider respectively parts five, the sixth and seventh;

Part one of Article 15 to add 2) with the offer of the following content:

4) in part three of Article 27 of the text in Uzbek of the word "сохталаштирилган b¸lad" shall be replaced with words "hisoblanada counterfeit".

Article 4. Bring in the Law of the Republic of Uzbekistan of July 20, 2006 No. ZRU-42 "About copyright and the related rights" (Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2006, No. 7, Art. 372; 2011, No. 12/2, of Art. 363; 2012, No. 12, Art. 336; 2013, No. 10, Art. 263; 2018, No. 4, Art. 224; 2019, No. 5, Art. 267; 2021, appendix to No. 4) following changes:

1) in parts one, the second and fourth Article 35 to replace the word of "fifty" with the word of "seventy";

The paragraph the fifth to state 2) to part one of Article 65 in the following edition:

"payments of compensation in the amount of twenty to one thousand basic settlement sizes instead of indemnification paid irrespective of the fact of causing losses, proceeding from nature of violation and degree of fault of the violator taking into account business customs".

Article 5. To provide to the Ministry of Justice of the Republic of Uzbekistan and other interested organizations execution, bringing to contractors and explanation among the population of essence and value of this Law.

Article 6. To the Cabinet of Ministers of the Republic of Uzbekistan:

bring decisions of the government into accord with this Law;

provide review and cancellation by state bodies of their regulatory legal acts contradicting this Law.

Article 7. This Law becomes effective from the date of its official publication.
