About modification of Rules of the wholesale market of electrical energy and capacity concerning carrying out selections of capacity of the new generating objects

1. 2. To the Ministry of Energy of the Russian Federation:

no later than January 1, 2023 to approve procedure for identification of threat of emergence of lack of capacity (taking into account admissible overflows) in case of the predicted delay of the beginning of delivery of capacity with use of the generating object which is selected following the results of selection of capacity of the new generating objects and also procedure for limiting determination of price value on capacity of the generating objects which are temporarily replacing the generating objects which are subject to construction following the results of selection of capacity of the new generating objects;

in case of identification for the consumers specified in the decision of the Government of the Russian Federation on carrying out selection of capacity of the new generating objects, considerable (more than for 20 percent) differences of the actual amounts of consumption of electrical energy (capacity) in year of the beginning of delivery of capacity following the results of selection of capacity of the new generating objects and within the next 2 years from forecast amounts of consumption to provide to the Government of the Russian Federation suggestions for improvement of procedure for determination of obligations on purchase of capacity for the corresponding buyers of the wholesale market of electrical energy and capacity.

Changes which are made to Rules of the wholesale market of electrical energy and capacity

1. The fifth Item 6 to state the paragraph in the following edition:

"the maximum prices specified in price requests for sale of electrical energy (for the generating objects which delivery of capacity is made according to the purchase and sale agreements (delivery) of capacity signed by results of the long-term competitive selection of capacity of the generating objects which are subject to construction, carried out according to the decision of the Government of the Russian Federation made in 2021 or in the years ahead, - also the values of variable (fuel) costs on development of electrical energy specified by the supplier of capacity in the price request according to Item 112 (1) these rules and the beginnings of delivery of capacity of the new generating object indexed from January 1 of year following the results of selection till January 1 of the current year according to the procedure, specified by the supplier of capacity in the price request according to Item 112 (1) these rules), the price applications submitted for participation in competitive selection for the days ahead and in competitive selection of requests for balancing of system at each o'clock of the specified period, - for the participants of the market functioning in price zones of the wholesale market.".

2. The eleventh Item 62 to add the paragraph with words ", and also according to the purchase and sale agreements (delivery) of capacity signed following the results of long-term competitive selection of capacity of the generating objects which are temporarily replacing the generating objects which are subject to construction following the results of long-term competitive selection of capacity of the generating objects which are subject to construction".

3. The tenth Item 100 to replace the paragraph with the text of the following content:

"According to the decision of the Government of the Russian Federation made according to Item 101 of these rules in the terms established by such decision long-term competitive selection of capacity of the generating objects which are subject to construction (further - selection of capacity of the new generating objects), from the beginning of the period of delivery of capacity from the date determined by the specified decision is made.

"The decision of the Government of the Russian Federation on carrying out selection of capacity of the new generating objects shall contain the following information:

start date of delivery of capacity following the results of selection of capacity of the new generating objects with use of the generating object put into operation new;
