About modification of the Code of penal procedure of the Republic of Armenia

Article 1. In Article 128 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code):

1) regarding 1 word "Detention for the purpose of Prevention of Committing by Person of Crime or Its Escape after Its Making" shall be replaced with words "Detention of person";

2) part 2 to recognize invalid;

2 parts 3 words of "criminal prosecution authority" to replace 3) in Item with the word of "investigator".

Article 2. To state article 130 of the Code in the following edition:

"Article 130. Detention for delivery in court of the person accused who is at large

1. In need of election of arrest as measure of restraint the investigator makes the decision on detention of the person accused on the person accused who is at large. In the decision year, month, day of its creation, this the person accused, the basis and the reason of detention, and also body of inquiry which is entrusted to perform detention are specified.

2. The person accused can be detained on the basis provided by this Article only if provisions of this Code allow to apply to it arrest as measure of restraint.

3. The employee of body of inquiry before detention of the person accused hands it on receipt the copy of the decision on detention. Right after capture under arrest the person accused is brought to the investigator. The fact of delivery of the person accused to the investigator is enshrined in the protocol of detention of person. In the protocol the name, surname, the person accused middle name, year, month, day, hour, minute, the place, conditions and the bases of its capture under arrest, name, surname, position, rank of the employee of body of inquiry which made arrest, statements of the detained person accused, year, month, day, hour and minute of delivery of the detained person accused to the investigator and creation of the protocol are entered.
