About modification of some legal acts of Ukraine concerning strengthening of responsibility for illegal mining
The Verkhovna Rada of Ukraine decides:
I. Make changes to the following legal acts of Ukraine:
1. Article 47 of the Code of Ukraine about administrative offenses (1984, appendix to No. 51, 1122) to state sheets of the Verkhovna Rada of USSR to the Art. in the following edition:
"Article 47. Violation of the right of state-owned property to subsoil

involve imposing of penalty on citizens in the amount of hundred to two hundred free minima income of citizens and on officials - from two hundred to five hundred free minima income of citizens".
2. Article 240 of the Criminal code of Ukraine (2001, 131) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 25-26, in the following edition:
"Article 240. Abuse of regulations of protection or use of subsoil, illegal mining
1. Violation of statutory rules of protection of subsoil if it created danger to life, human health or the environment, and also illegal mining of local value in considerable size
are punished by penalty from five hundred to eight hundred free minima income of citizens or restriction of freedom for a period of up to two years, or imprisonment for the same term.
2. Violation of statutory rules of use of subsoil if it created danger to life, human health or the environment, and also illegal mining of local value in large size or illegal mining of nation-wide value
are punished by penalty from three thousand to five thousand free minima of the income of citizens or restriction of freedom for a period of up to three years, or imprisonment for the same term.
3. The acts provided by parts one or the second this Article, made in the territories or objects of natural and reserved fund or made by previous concert by group of persons, or which are commited by person previously convicted for the crime provided by this Article, or the official with use of official position
