About introduction of amendments to the Law of Ukraine "About the National agency of Ukraine concerning identification, search and asset management, received from corruption and other crimes" concerning guarantees of the rights of investors

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About the National agency of Ukraine concerning identification, search and asset management, received from corruption and other crimes" (Sheets of the Verkhovna Rada of Ukraine, 2016, No. 1, the Art. 2, No. 11, Art. 129; 2019, No. 42, Art. 238; 2020, No. 2, Art. 5, No. 47, Art. 408) following changes:

1. To state item 4 of part one of Article 1 in the following edition:

"4) asset management - activities for ownership, use and the order of assets which it is seized in criminal proceedings in the case of recognition unreasonable assets and their collection in the income of the state and the issue of their transfer to the National agency of Ukraine concerning identification, search and asset management, received from corruption and other crimes, that is ensuring safety of assets, preserving (whenever possible - increase) their economic cost, their transfer to management or realization of assets in the cases and procedure provided by this Law and also realization of the assets confiscated in criminal proceedings or collected by a court decision in the income of the state owing to recognition their unreasonable is resolved".

2. To add part one of Article 10 with Item 8-1 of the following content:

"8-1) provides to the investigator, the prosecutor, the investigative judge, court written explanations about possibility of ensuring effective management with the National agency of asset and preserving (whenever possible - increases) its economic cost.

Such explanation is made in response to the address of the investigator, prosecutor, investigative judge, court within five working days from the date of receipt of such address by the National agency. The form of such statement affirms the joint order of Office of the Attorney-General and the National agency".
