About modification of some legal acts of Ukraine concerning implementation of provisions of some international agreements and European Union directives in the field of protection of animal and flora

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Verkhovna Rada of USSR, 1984, appendix to No. 51, the Art. 1122):

Part the second articles 13 after figures "51" to add 1) with figures "89", and after figures "139" - words and figures "Article 154 part three";

Article 29 after part two to add 2) with new part of the following content:

"Features of procedure for application of confiscation of animals are established by this Code and other laws of Ukraine".

With respect thereto third to consider part part four;

Article 89 to state 3) in the following edition:

"Article 89. Animals abuse

Animals abuse - mockery at animals, including the homeless which entailed their tortures inflicted on them physical pain, suffering, but did not entail bodily harms, mutilations or death, leaving of animals to the mercy of fate, and also other abuses of regulations of content, the address and transportation of animals, stipulated by the legislation, except 87 - 88-2, 154 of this Code provided by Articles 85,,

involve imposing of penalty from two hundred to three hundred free minima income of citizens with confiscation of animal if stay of animal at the owner constitutes threat for his life or health.

The actions provided by part one of this Article, made concerning two and more animals, either group of persons, or person who within year was subjected to administrative punishment for the same violation

involve imposing of penalty from three hundred to five hundred free minima income of citizens or administrative detention for a period of up to fifteen days with confiscation of animal if stay of animal at the owner constitutes threat for his life or health";

4) in Article 90:
