About introduction of amendments to the Law on Prosecutor's office No. 3/2016

The Parliament adopts this organic law.

Art. I. - In the Law on Prosecutor's office No. 3/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 69-77, 113), with subsequent changes, to make the following changes:

1. In Article 17:

part (to add 14) with words ", except for case of the termination of powers in case of dismissal owing to assessment of activities or application of authority punishment.";

part (to add 15) after words of "Attorney-General" with the words "or suspensions of powers of the Attorney-General in connection with excitement concerning it criminal prosecution";

part (to state 16) in the following edition:

"(16) the Acting as the Attorney-General is selected by the Supreme council of prosecutors from among the acting prosecutors according to selection criteria of persons for occupation of the corresponding position. The selected candidacy is proposed to the President of the Republic for position assignment of the acting as the Attorney-General. Provisions of parts (11) and (12) are applied as appropriate. Temporary fulfillment of duties of the Attorney-General cannot exceed 12 months.".

2. Part (Article 18 to add 4) with words ", except for case of the termination of powers of the Attorney-General in case of release from post owing to assessment of its activities or application of authority punishment or discharge of the Attorney-General from position in connection with excitement against it criminal prosecution.".

3. To add part 1 of Chapter V with Article 27-1 of the following content:

"Article 27-1. Ensuring temporary fulfillment of duties

(1) Ensuring temporary fulfillment of duties of the chief prosecutor of prosecutor's office, the deputy chief prosecutor of prosecutor's office, the chief prosecutor of division of the Prosecutor General's Office or the deputy chief prosecutor of division of the Prosecutor General's Office is performed by the order of the Attorney-General.
