About introduction of amendments to the Law of the Kyrgyz Republic "About boundary representatives"

Article 1.

Bring in the Law of the Kyrgyz Republic "About boundary representatives" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2015, No. 3, the Art. 226) the following changes:

The Law to add 1) with Articles 4-1 - 4-3 following of content:

"Article 4-1. Conditions and limits of use of physical force, special means and weapon by boundary representatives

1. In case of accomplishment of the assigned obligations on protection of frontier boundary representatives have the right to carrying and application of special means, weapon, and also to use of physical force in the cases and procedure established by this Law.

2. The procedure for issue to boundary representatives of special means and weapon is determined by the Cabinet of Ministers of the Kyrgyz Republic.

Article 4-2. Application of special means by boundary representatives

1. In case of accomplishment of the assigned obligations the boundary representative has the right to apply special means:

1) in case of convoy and protection of the detained persons as a part of border duty if good reasons to believe are had that they can make escape, do harm to people around or own health;

2) for reflection of attack on the military personnel and other physical persons;

3) for the prevention and suppression of other offenses, and also justifiable defense and in urgent cases.

2. It is forbidden to apply special means in the relation:

1) women with visible signs of pregnancy, persons with strong indications of disability, minors when their age is obvious or known, except as specified rendering by specified persons armed resistance, making of group or other attack, life-threatening and to health of citizens;
