About modification of some legal acts of Ukraine concerning transition of the rights to the parcel of land in connection with transition of the rights to the real estate unit which on it is placed

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 3-4, 27):

Article 120 to state 1) in the following edition:

"Article 120. Transition of the right to the parcel of land in case of acquisition of property rights, economic maintaining, operational management on the real estate unit (except the apartment house), object of construction in progress, located on it

1. In case of acquisition of property right to the real estate unit (the apartment house (except apartment), other building or construction), the object of construction in progress located on the parcel of land (except lands of the state-owned, utility property), the property right to such parcel of land at the same time passes from the alienor (the previous owner) of such object to the acquirer of such object without change of its purpose. If the alienor (the previous owner) of such object possessed share in the right of common property to the parcel of land to the acquirer of this object passes the property right to such share. During transaction, providing transition of the property right to the specified object, shall observe requirements of part of the sixteenth this Article.
