About introduction of amendments to some acts of the Government of the Russian Federation concerning preparation and conducting conscription of citizens of the Russian Federation

Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning preparation and conducting conscription of citizens of the Russian Federation.

Changes which are made to acts of the Government of the Russian Federation concerning preparation and conducting conscription of citizens of the Russian Federation

1. In Regulations on the conscription of citizens of the Russian Federation approved by the order of the Government of the Russian Federation of November 11, 2006 No. 663 "About approval of the Regulations on conscription of citizens of the Russian Federation" (The Russian Federation Code, 2006, No. 47, Art. 4894; 2014, No. 21, Art. 2717; 2017, No. 41, Art. 5975; 2021, No. 2, Art. 397):

a) in Item 2:

in paragraph one:

after the words "military commissariat" to add with words "the subject of the Russian Federation (further - military commissariat)";

shall be replaced with words words of "local administration" "executive bodies of the subject of the Russian Federation and local government bodies";

word in paragraph three "headquarters of the respective military districts (the headquarters of the Northern Fleet)" shall be replaced with words "top military commanders of the respective military districts (Northern Fleet)";

b) state Item 3 in the following edition:

"3. Conscription is performed by the draft commission created in each municipality having the status of the municipal district, city district or the intracity territory of the federal city (further - the draft commission), the solution of the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) on representation of the military commissioner of the subject of the Russian Federation (further - the military commissioner).

For implementation of methodical management of the subordinate draft commissions, control of activities of the draft commissions and accomplishment of other tasks determined by the Federal Law "About Conscription and Military Service", the solution of the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) creates the draft commission of the subject of the Russian Federation.";

c) add with Items 3 (1) - 3(3) following contents:

"3(1). For the purpose of high-quality holding the actions connected with appeal of citizens on military service methodical preparation is performed:

a) as required - according to the plan of the General Staff of the Armed Forces of the Russian Federation instructor and methodical charges with chiefs of organizational and mobilization managements of headquarters of military districts (Northern Fleet), chiefs of departments of appeal and training of citizens for military service of organizational and mobilization managements of headquarters of military districts (Northern Fleet), chiefs of branches (departments of branches) of the Main center of military-medical examination are carried out;

b) once a year (in March) - according to plans of headquarters of military districts (Northern Fleet) are carried out one - or two-day instructor and methodical charges with chairmen of the draft commissions of subjects of the Russian Federation (under approval), officials of military commissariats (military commissioners, chiefs of departments of appeal and training of citizens for military service, chiefs of departments of forming and sending teams of departments of appeal and training of citizens for military service and chiefs of the centers of military-medical examination).

Programs and terms of carrying out charges affirm chiefs of headquarters of military districts (Northern Fleet);

c) before the next appeal of citizens on military service according to the solution of management officials of subjects of the Russian Federation (heads of the supreme executive bodies of the government of subjects of the Russian Federation) according to plans of military commissioners are carried out one - or two-day instructor and methodical charges with chairmen of the draft commissions, military commissioners of municipalities, chiefs of departments of preparation and appeal of citizens on military service of military commissariats of municipalities, the doctors leading work on medical examination of recruits, professional psychological selection specialists and chiefs of assembly points.

Programs and terms of carrying out charges are coordinated with management officials of subjects of the Russian Federation (heads of the supreme executive bodies of the government of subjects of the Russian Federation) and affirm military commissioners;

d) according to plans of military commissariats of municipalities - one-day instructor and methodical charges with the members of the draft commissions, specialists doctors participating in medical examination of recruits, the professional psychological selection specialists, technical workers involved to work on recruiting stations.

Plans and terms of carrying out charges are coordinated with heads of municipalities in which the draft commissions are created, and affirm military commissioners of municipalities.

3(2). For the purpose of ensuring activities of the draft commission the necessary territories and rooms equipped with the tools and medical property necessary for medical examination, and also the equipment and material means necessary for holding actions for professional psychological selection of recruits are allocated and equipped.

3(3). For the purpose of realization of tasks on conducting conscription the military commissioner:

a) no later than 2 months prior to the beginning of the next appeal of citizens on military service develops, approves with the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) and submits for approval to the chief of staff of the military district (Northern Fleet) the plan of preparation and carrying out appeal of citizens for military service in the subject of the Russian Federation;

b) till March 10 (till September 10) represents to the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) the draft decision about creation of the draft commissions with indication of their members;

c) not later than 30 calendar days prior to the beginning of each next appeal of citizens on military service approves in coordination with executive body of the government of the subject of the Russian Federation in the field of health protection the plan of the organization of preparation and carrying out physical examination and medical examination of recruits including the following events:

the direction in the medical organizations of the state and municipal health care systems of requests for allocation of the specialists doctors and health workers with secondary medical education involved to performing medical examination of recruits, including control medical examination of the recruits who received delay or release from conscription for health reasons, release from execution of conscription in connection with recognition their not suitable for military service for health reasons and the recruits who declared disagreement with the conclusion about their validity to military service by results of medical examination, and also medical examination of the recruits who are called up for military service before the direction them to the place of passing of military service;

scheduling of submission to the draft commission of the subject of the Russian Federation of personal records of the recruits recognized by the draft commissions is limited suitable for military service, not suitable for military service and temporarily not suitable for military service;

performing control medical examination of the recruits who received delay or release from conscription for health reasons, release from execution of conscription in connection with recognition their not suitable for military service for health reasons and the recruits who declared disagreement with the conclusion about their validity to military service by results of medical examination;

performing medical examination of the recruits who are called up for military service;

representation by the military commissioner of the municipality (municipalities) to the military commissioner of reports on results of physical examination and medical examination of recruits;

informing management official of the subject of the Russian Federation (head of the supreme executive body of the government of the subject of the Russian Federation) on results of physical examination and medical examination of recruits;

d) till December 10 submits for approval to the management official of the subject of the Russian Federation (the head of the supreme executive body of the government of the subject of the Russian Federation) after approval of the head of executive body of the government of the subject of the Russian Federation in the field of health protection the list of the medical organizations of the state health care system (except for the medical organizations subordinated to federal executive bodies) and the medical organizations of municipal health care system in which out-patient or stationary physical examination of citizens in case of conscription will be conducted.";

d) in item 4:

in the subitem "an" of the word of "local administration" shall be replaced with words "municipality";

add with subitems "and (1)" and "and (2)" the following content:

"and (1)) the list of members of the draft commission approved with the head of the municipality in which the draft commission is created represents till March 5 (till September 5) to the military commissioner;

and requests (2)) till March 15 (till September 15) for the purpose of performing medical examination on the citizens who are subject to challenge on the actions connected with conscription:

from the medical organizations irrespective of form of business - the information about citizens characterizing condition of their health including about the citizens staying on the registry (observation) concerning mental disturbances, drug addiction, alcoholism, toxicomania, abuse of drugs and other toxic substances, the infection with human immunodeficiency virus consisting on dispensary observation concerning other diseases with indication of the diagnosis and date of registration (observation), medical records of the patients receiving medical care in out-patient conditions, and if necessary other medical documents (medical records of inpatients, clinical records, roentgenograms, protocols of ad hoc methods of research and other medical documents), and also other data necessary for performing medical examination of recruits;

from federal state institutions of medico-social examination - the information about persons recognized as disabled people, and on the citizens who are disabled people of the I group or having other group of disability without specifying of term of re-examination, the copy of the protocol of conducting medico-social examination of the citizen and acts of medico-social examination of the citizen, certified by the signature of the head and seal of the relevant bureau of medico-social examination;

from the centers of the psychology and pedagogical, medical and public assistance, special teaching and educational facilities of the opened and closed types, the organizations performing educational activities for adapted main general education programs - the pedagogical characteristics and medical documents characterizing condition of their health;

for entering of data into documents of military accounting:

from federal courts and magistrate judges - lists of persons concerning which sentences took legal effect;

from law-enforcement bodies - lists of persons staying on the registry for offenses;

from bodies of inquiry and pretrial investigation - lists of persons concerning which criminal cases are brought (criminal prosecution is performed) or concerning which criminal cases are brought to trial;";

state the subitem "e" in the following edition:

"e) informs with assistance of local government body and officials of the organizations the population through mass media on the course of appeal of citizens on military service, will organize with assistance of local government body and officials of the organizations holding actions for military professional orientation of the citizens who are subject to conscription and works on explanation to the population of legislative and other regulatory legal acts concerning execution of conscription;";

to add the subitem "k" after words of "task on questions" with words of "preparation and the organization";

e) to add Item 6 after words of "(municipalities)" with the words "in form according to appendix No. 1";

e) add with Item 11 (1) the following content:

"11(1). Members of the draft commission shall know the legislation of the Russian Federation which regulates questions of appeal of citizens on military service, to arrive to time for meetings of the draft commission established by the chairman of the draft commission (in case of impossibility of arrival on meeting of the draft commission beforehand to inform on it the chairman (vice-chairman) of the draft commission) and are allocated with the following rights:
