About modification of the Law of the Azerbaijan Republic "About mediation"
Being guided by Items 10 and 12 of part I of article 94 of the Constitution of the Azerbaijan Republic, Millie DECIDES: Majlis of the Azerbaijan Republic
In the Law of the Azerbaijan Republic "About mediation" (Collection of the legislation of the Azerbaijan Republic, 2019, No. 4, Article 597; 2020, No. 6, Article 683, No. 7, article 856, No. 12 (the I book), Article 1442) to make the following changes.
1. in Article 11.1 of the word "legal entity" shall be replaced with words "the non-commercial legal entity".
2. repeal Articles 21.10 and 29.4.
3. in Article 26.5 to replace the word of "Party" with the word "Mediator", the word "shall" be replaced with the word "shall".
4. in Article 28.4 of the word "court within which competence the dispute is" shall be replaced with words "Council of mediation".
5. under Article 31:
5.1. state Articles 31.1 and 31.4 in the following edition:
"31.1. At any stage of legal procedure the court taking into account the facts of the case, on own initiative or based on the address of one of the parties can suggest them to resolve dispute by means of mediation. In case of the conclusion between parties "Agreement on mediation process application", judicial proceedings stop before submission of the voluntary settlement and the protocol on results of process of mediation.";
"31.4. In case of the dispute resolution between the parties by means of mediation the voluntary settlement is brought into court. In case of approval of the voluntary settlement the court stops production on this case.";
5.2. in Article 31.5 to exclude the words "and the number of legal cases on which production is stopped based on achievement of the voluntary settlement according to this Law".
6. in Article 33.3 of the word to "current legislation" to replace with the word to "law".
