About modification of the Labor code of the Republic of Moldova No. 154/2003

The Parliament adopts this organic law.

Art. I. - In the Labor code of the Republic of Moldova No. 154/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, to make the following changes:

1. Add the code with Article 78-1 of the following content:

"Article 78-1. Provision to workers of the days off in case of suspension of educational process in the mode of physical presence

(1) in case of suspension in emergency situations of educational process in educational institutions in the mode of physical presence, after acceptance of special measures by competent authorities on safety, protection of life and health of the population, with the consent of the employer the days off for baby sitting for the entire period of suspension of educational process in the mode of physical presence with payment at the same time of benefit in the amount of at least 50 percent of base pay of the worker are provided to one of parents or the guardian.

(2) part Provisions (1) are applied:

a) to parents or guardians of the children enlisted in educational institution aged up to 12 years;

b) to parents or guardians of the children enlisted in educational institution with limited opportunities.

(3) the Days off are provided according to the written application of one of parents or the guardian to which the declaration under the personal liability signed by both parents, except for incomplete families or the guardian who will look after the child during this period is enclosed.

(4) in case of the families with several children conforming to requirements of this Article, the days off are provided to only one of parents.

(5) If by results of check it is determined that both parents used the days off at the same time, the further possibility of receipt of the benefit provided according to this Article is cancelled.

(6) the Benefit provided by this Article is paid by the employer. In certain cases the benefit can be paid, fully or partially, from means of the government budget according to the procedure, established by the Government.".
