About modification of Administrative regulations of the Ministry of Industry and Trade of the Russian Federation on provision of the state service in issue of licenses and other allowing documents for the export and (or) import of separate types of goods approved by the Order of the Ministry of Industry and Trade of the Russian Federation of October 18, 2017 No. 3624

According to part 5 of Article 13, article 24 of the Federal Law of December 8, 2003 No. 164-FZ "About bases of state regulation of foreign trade activity" (The Russian Federation Code, 2003, No. 50, Art. 4850; 2020, No. 52, the Art. 8592), Articles 11 - 14 Federal Laws of July 27, 2010 No. 210-FZ "About the organization of provision of the state and municipal services" (The Russian Federation Code, 2010, No. 31, Art. 4179; 2021, No. 1, the Art. 48), subitem 5.8.12 of Item 5 of the Regulations on the Ministry of Industry and Trade of the Russian Federation approved by the order of the Government of the Russian Federation of June 5, 2008 No. 438 "About the Ministry of Industry and Trade of the Russian Federation" (The Russian Federation Code, 2008, No. 24, Art. 2868; 2021, No. 30, the Art. 5787), the order of the Government of the Russian Federation of May 16, 2011 No. 373 "About development and approval of administrative regulations of implementation of the state control (supervision) and administrative regulations of provision of the state services" (The Russian Federation Code, 2011, No. 22, Art. 3169; 2021, 31, of the Art. 5904) I order to No.:

1. Approve the enclosed changes which are made to Administrative regulations of the Ministry of Industry and Trade of the Russian Federation on provision of the state service in issue of licenses and other allowing documents for the export and (or) import of separate types of goods approved by the order of the Ministry of Industry and Trade of the Russian Federation of October 18, 2017 No. 3624 "About approval of Administrative regulations of the Ministry of Industry and Trade of the Russian Federation on provision of the state service in issue of licenses and other allowing documents for export and (or) import of separate types of goods" (registration number 50671) is registered by the Ministry of Justice of the Russian Federation on April 9, 2018, with the changes made by orders of the Ministry of Industry and Trade of the Russian Federation of October 25, 2018 No. 4237 (it is registered by the Ministry of Justice of the Russian Federation on January 21, 2019, registration number 53447), of August 17, 2020 No. 2749 (registration number 60851) is registered by the Ministry of Justice of the Russian Federation on November 11, 2020.

2. This order becomes effective on December 1, 2021.

Changes which are made to Administrative regulations of the Ministry of Industry and Trade of the Russian Federation on provision of the state service in issue of licenses and other allowing documents for the export and (or) import of separate types of goods approved by the Order of the Ministry of Industry and Trade of the Russian Federation of October 18, 2017 No. 3624

1. State Item 2 in the following edition:

"2. Provision of the state service is performed by means of the following information systems:

2.1. Provision of ministerial procedures on documents acceptance from the applicant and issue of result of the state service is performed by means of the following information systems (further - information systems):

information system - the automated information system "Foreign Trade Information" (further - AIS VTD) on the website of support of participants of foreign trade activity on the Internet to the address: http://non-tariff.gov.ru till December 31, 2022;

the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the EPGU Portal) on the website on the Internet to the address: www.gosuslugi.ru;

the state information system of the industry (further - GISP) on the website of support of participants of foreign trade activity on the Internet to the address: https://gisp.gov.ru - since January 1, 2023;

the information system "One Window" in the field of foreign trade activity (further - IS "One Window") on the website on the Internet to the address: http://myexport.exportcenter.ru/.

2.2. Ensuring provision of ministerial procedures on the party of the Ministry is performed by means of the following information systems:

AIS VTD - till December 31, 2022;

GISP - since December 1, 2021 concerning the applications submitted in electronic form through IS "One Window", through the EPGU Portal, for export of the following types of goods to which measures of non-tariff regulation in trade with the third countries are applied, stipulated in Item 4 Protocols on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014) (further - measures of non-tariff regulation):

a) wild live animals, separate wild-growing plants and wild-growing medicinal raw materials (Section 2.6 of Appendix No. 2 to the Decision of Board of the Eurasian economic commission of April 21, 2015 No. 30 "About measures of non-tariff regulation" (the official site of the Eurasian economic commission of http://www.eurasiancommission.org/, on April 22, 2015) with the changes made by the Decision of Board of the Eurasian economic commission of June 15, 2021 No. 66 (the official site of the Eurasian economic commission of https://eaeunion.org/, on June 18, 2021) (further - the Solution No. 30) which is obligatory for the Russian Federation according to the Agreement on the Eurasian Economic Union ratified by the Federal Law of October 3, 2014 No. 279-FZ "About ratification of the Agreement on the Eurasian Economic Union" (The Russian Federation Code, 2014, No. 40, the Art. 5310) (further - the Agreement on the Eurasian Economic Union) in the relation:

live fish (except decorative fish); Crustacea, in armor or without armor, live mollusks, in sink or without sink, live water invertebrates, except Crustacea and mollusks, live eggs (tsist) Artemia salina;

separate wild-growing plants;

b) precursors of drugs and psychotropic substances (Section 2.12 of Appendix No. 2 to the Solution No. 30, which is obligatory for the Russian Federation according to the Agreement on the Eurasian Economic Union).

Concerning other statements and projects of permissions - since January 1, 2023".

2. State Item 5 in the following edition:

"5. Information on provision of the state service is placed on the EPGU Portal and on the website of the Ministry.

On the EPGU Portal the following information is placed:

1) the exhaustive list of the documents necessary for provision of the state service, the requirement to document creation, and also the list of documents which the applicant has the right to provide on own initiative;

2) circle of applicants;

3) term of provision of the state service;

4) results of provision of the state service, procedure for provision of the document which is result of provision of the state service;

5) the amount of the state tax collected for provision of the state service;

6) the exhaustive list of the bases for suspension or refusal in provision of the state service;

7) about the applicant's right to pre-judicial (extrajudicial) procedure for appeal of actions (failure to act) and the decisions made (performed) during provision of the state service;

8) the forms of statements (notifications, messages) used by provision of the state service;

9) the list of the regulatory legal acts regulating provision of the state service (with indication of their details and sources of official publication).

Information on the EPGU Portal and on the website of the Ministry about procedure and terms of provision of the state service based on the data containing in the federal state information system "Federal Register of the State and Municipal Services (Functions)" is provided to the applicant free of charge.

The information access about terms and procedure for provision of the state service is performed without accomplishment by the applicant of any requirements, including without use of the software which installation on technical means of the applicant requires the conclusion of license or other agreement with the owner of the software providing collection of payment, registration or authorization of the applicant, or provision of personal data by it.".

3. Third Item 8 to state the paragraph in the following edition:

"by placement on the website of the Ministry, the EPGU Portal, in IS "One Window" and AIS VTD and GISP.".

4. The paragraph one of Item 10 after the words "and also takes place in AIS VTD" to add with words ", GISP, IS "One Window".

5. Paragraph two of the subitem 1 of Item 16 after the words "on the EPGU Portal" to add with the words "IS "One Window"".

"19. For execution of the license (permission) the applicant directs to the Ministry the application with appendix:

the documents necessary for receipt of the license (permission), and their inventory containing in the address with indication of in case of filing of application by the mailing or in case of the personal address to expedition of the Ministry of method of receipt of the license (the license in electronic form without registration of paper or with paper registration);

documents (data) necessary for receipt of the license (permission), with indication of in case of filing of application in electronic form, signed by the strengthened qualified digital signature of the authorized person of the applicant with use of information systems, method of receipt of the license (licenses in electronic form without registration of paper or with paper registration).".

8. State Item 20 in the following edition:

"20. The statement for execution of the license concerning types of the goods provided by subitems "an" and "b" of Item 2.2 of Administrative regulations can be submitted in electronic form, signed by the strengthened qualified digital signature of the authorized person of the applicant, by means of IS "One Window" with indication of method of receipt of the license (the license in electronic form without registration of paper or with paper registration) and application of documents (data) necessary for receipt of the license, or any of specified in Item 19 of Administrative regulations by method.".

9. In Item 21:

10. State Item 22 in the following edition:

"22. In case of submission of documents, specified in Item 21 of Administrative regulations, on paper each leaf of the provided copies of documents shall be certified by the sign manual and the applicant's seal (in the presence) or copies of documents shall be stitched and their last sheets are certified by the sign manual and the applicant's seal (in the presence).

Documents, stipulated in Item 21 (except for subitem 2 of the specified Item) Administrative regulations, can be provided in the form of electronic documents (data) signed by the strengthened qualified digital signature of the authorized person of the applicant with use of AIS VTD, GISP, IS "One Window" or EPGU Portal and shall meet the requirements approved according to the subitem "an" of Item 2 of the order of the Government of the Russian Federation of July 7, 2011 No. 553 "About procedure for registration and submission of the statements and other documents necessary for provision of the state and (or) municipal services in the form of electronic documents" (The Russian Federation Code, 2011, No. 29, the Art. 4479).

Responsibility for reliability of the submitted documents (data) and information is born by the applicant.".

11. Third Item 25 to state the paragraph in the following edition:

"the electronic draft copy of permission created in AIS VTD, GISP or on the EPGU Portal.".

12. In Item 30 of the word "or by means of interdepartmental electronic interaction" shall be replaced with words "or by the direction of interdepartmental request, including electronically with use of single system of interdepartmental electronic interaction.".

13. State Item 33 in the following edition:

"33. In case of lack of the documents specified in subitems 4 - the 5th Item 21 of Administrative regulations, the Ministry requests confirmation of availability and (or) reliability of such documents from state bodies by the appeal to information resources of these state bodies or by the direction of interdepartmental request, including electronically with use of single system of interdepartmental electronic interaction (in the absence of technical capability check is not performed).".

14. State Item 34 in the following edition:

"34. The basis for refusal in documents acceptance, necessary for provision of the state service concerning types of the goods specified in subitems "an" and "b" of Item 2.2 of Administrative regulations is the incomplete set of documents (data) or lack of data on payment of the state fee.".

15. To add Item 36 paragraph two after the words "in documents" with words "(data)".

16. State Item 39 in the following edition:

"39. Bank details for payment of the state fee are posted on the website of the Ministry. In the payment order the unique identifier of charge which is automatically created in AIS VTD, GISP and is transferred to personal account of the applicant in IS "One Window", the EPGU Portal is specified.".

17. The paragraph one of Item 43 after words of "work of the Ministry" to add with words "if other is not established by Administrative regulations.".

18. State Item 44 in the following edition:

"44. In case of filing of application in electronic form through the Portal EPGU, AIS VTD, GISP and IS "One Window" registration of a statement is performed automatically in day of filing of application according to the working schedule of the Ministry if other is not provided by Items 94.1 - 94.6 Administrative regulations.".

19. State Item 47 in the following edition:

"47. Indicators of quality of provision of the state service are:

adherence to deadlines of provision of the state service;

observance of the right of applicants to receipt of up-to-date and reliable information about procedure for provision of the state service;

the number of interactions of the applicant with officials by direct provision of the state service and their duration;

lack of consideration of claims to decisions and actions (failure to act) of officials of the Ministry.

The possibility of accomplishment of the following actions by means of the EPGU, IS "One Window", GISP and AIS VTD Portal is provided to the applicant:

receipts of information on procedure and terms of provision of the state service;

forming of the statement for provision of the state service;

acceptance and registration of a statement and other documents (data) necessary for provision of the state service;

payments / provisions of details for payment (in case of IS "One Window") the state fee for provision of the state service collected in accordance with the legislation of the Russian Federation;

receipts of result of provision of the state service;

receipts of data on the course of accomplishment of request.

The possibility of accomplishment of the following action by means of the EPGU and AIS VTD Portal is provided to the applicant:

pre-judicial (extrajudicial) appeal of decisions and actions (failure to act) of the body providing the state service and also his officials.".

20. State Item 51 in the following edition:

"51. In case of filing of application in electronic form the applicant shall use the strengthened qualified digital signature or the strengthened unqualified digital signature of physical person which certificate of key of check is created and is used in the infrastructure providing information and technological interaction of the information systems used for provision of the state and municipal services electronically in the procedure established by the Government of the Russian Federation. If the application is signed by person who does not have rights to sign without power of attorney the power of attorney signed by the strengthened qualified digital signature of person having such right is put to the statement.

For registration by means of GISP and IS "One Window" of the export license of separate types of the goods specified in the subitem "an" of Item 2.2 of Administrative regulations, the documents specified in Items 21 - 22 Administrative regulations, can be provided in the form of electronic documents (data) certified by the strengthened qualified digital signature of the authorized person of the applicant.

In case of giving by means of statement GISP and IS "One Window" in electronic form on licensing for export of separate types of the goods specified in the subitem "b" of Item 2.2 of Administrative regulations, the import permit of specific batch of precursors of drugs and psychotropic substances issued by competent authority of the state - the importer, or the formal notice of this body that the specified permission is not required can be provided in the form of the scanned copy of the relevant document certified by the strengthened qualified digital signature of the authorized person of the applicant.".

21. To add the paragraph of the seventh of Item 53 after the words "with use of the EPGU Portal" with words "and IS "One Window".

22. State Item 56 in the following edition:

"56. The address of the applicant with the documents specified in Items 21 and 25 of Administrative regulations, which arrived in the Ministry is subject to registration within two working days in case of their receipt in the Ministry. Information on registration of such address of the applicant is entered into electronic system of accounting of documents. The entering number is assigned to the address of the applicant with the documents specified in Items 21 and 25 of Administrative regulations, which arrived on paper.".

23. State Item 58 in the following edition:

"58. The statement on licensing in day of receipt or is registered next day the Ministry. Registration number in ascending order according to the Instruction about execution of the statement on licensing for export and (or) import of separate types of goods and about execution of such license approved by the Solution No. 199, which is obligatory for the Russian Federation according to the Agreement on the Eurasian Economic Union is assigned to the statement on licensing.".

24. State Item 61 in the following edition:

"61. The application in electronic form submitted through the Portal EPGU or IS "One Window", signed and certified by the strengthened qualified digital signature of the applicant is registered the Ministry.

In case of submission of documents with use of the EPGU Portal in respect of each ministerial procedure fixing of result of rendering the state service is provided.".

25. State Item 64 in the following edition:

"64. No later than the working day following behind day of registration of a statement, information on registration number and registration date of the statement is placed in AIS VTD, GISP, either in IS "One Window", or on the EPGU Portal.".

26. State Item 66 in the following edition:

"66. The basis for ministerial procedure is non-presentation by the applicant on own initiative of documents (data) specified in subitems 4 - the 5th Item 21 of Administrative regulations.

Submission of documents (data) and (or) information necessary for provision of the state service, is performed including in electronic form with use of single system of interdepartmental electronic interaction and the regional systems of interdepartmental electronic interaction connected to it on interdepartmental request of the body providing the state service.".

27. To add Items 67 and 68 after the word of "documents" with the word of "(data)".

28. Add Item 69 with the paragraph of the following content:

"Provisions of this Item, and also Item 71 of Administrative regulations are not applied to statements on licensing for export of separate types of the goods specified in the subitems "an" and "b" of Item 2.2 of Administrative regulations submitted in electronic form through the Portal EPGU, IS "One Window". The basis for ministerial procedure according to such statements is automatic registration of a statement according to the procedure, established by Administrative regulations. Signing by the strengthened qualified digital signature of the authorized person of responsible structural division of the Ministry of the export license of separate types of the goods specified in subitems "an" and "b" of Item 2.2 of Administrative regulations is result of ministerial procedure.".

29. In Item 70:

a) the paragraph one to state in the following edition:

"70. The applicant is informed on the course of provision of the state service by means of the EPGU, IS "One Window", AIS VTD, GISP Portal.";

b) add paragraph two with words "if other is not provided by Administrative regulations.".

30. State Item 74 in the following edition:

"74. The license (permission) is electronically signed by the strengthened qualified digital signature of the authorized person of responsible structural division of the Ministry.".

31. State Item 78 in the following edition:

"78. Payment of the state fee for provision of the state service and payment of other payments levied in accordance with the legislation of the Russian Federation with use of information systems is not performed.".

32. In the paragraph the second Item 80 of the word "and in AIS VTD" shall be replaced with words ", in AIS VTD and GISP".

33. In Item 83:

a) in paragraph four after words "EPGU Portal" to add with the word", GISP";

b) the fifth to state the paragraph in the following edition:

"The decision on refusal in licensing for export of separate types of goods which application is submitted for obtaining with use of IS "One Window" and the EPGU Portal is placed in IS "One Window", the EPGU Portal.".

34. Items 88 - 90 to recognize invalid.

35. State Item 92 in the following edition:

"92. When forming request to the applicant it is provided:

a) possibility of copying and preserving the statement with appendix of necessary documents (the information about them) specified in Items 21 and 22 of Administrative regulations necessary for provision of the state service;

b) possibility of seal on paper copies of the electronic application form;

c) automatic preserving or preserving the values which are earlier entered into the electronic application form at any time at the request of the user, including in case of errors of input and return for repeated input of values to the electronic application form;

d) automatic filling of fields of the electronic application form with the data containing in the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically" (further - single system of identification and authentication), and the data published on the EPGU Portal in AIS VTD, GISP, IS "One Window" regarding the data which are absent in single system of identification and authentication;

e) opportunity to return on any of stages of filling of electronic request form without loss of earlier entered information;

e) possibility of access for the applicant on the EPGU Portal, in AIS VTD, IS "One Window" or GISP to the requests which are earlier sent by it within at least one year, and also to partially created requests - within at least three months;

g) preserving the values which are earlier entered into electronic form of the project of permission at any time at the request of the user, including in case of errors of input and return for repeated input of values (if technically possible);

h) filling of fields of electronic form of the project of permission prior to input of data by the applicant with use of the data placed in single system of identification and authentication, and the data published on the EPGU Portal in AIS VTD regarding the data which are absent in single system of identification and authentication.".

36. Item 94 paragraph two after the words "in AIS VTD" to add with the word", GISP".

37. Include Items 94.1 - 94.6 following of content:

"94.1. By provision of the state service the following ministerial procedures are electronically performed:

submission of necessary documents by the applicant;

acceptance and document registration in case of receipt of information from the State information system on the state and municipal payments about payment of the state fee;

check of authenticity of the strengthened qualified digital signature used in case of the request for provision of the state service;

forming and direction of interdepartmental requests;

consideration of the submitted documents, execution of the license (permission) or refusal in licensing (permission).

In case of submission of documents electronically, including through the Portal EPGU and IS "One Window", acceptance and registration of declarative documents without the need for submission of paper documents by the applicant are provided.

94.2. The applicant submits documents (data) specified in Items 21 - 22 Administrative regulations, in the form of the electronic documents signed by the strengthened qualified digital signature of the applicant including through the Portal EPGU and IS "One Window". The structure and format of the contract in foreign trade represented in electronic form are given in Appendix No. 6 to Administrative regulations.

The statement and documents (data) directed with use of IS "One Window" are signed certified) by person, the representative to act on behalf of the applicant without power of attorney, with use of the strengthened qualified digital signature.

The submitted documents signed the strengthened qualified digital signature are recognized equivalent to the documents signed by the sign manual and provided on paper.

Formatno-logichesky verification of the declarative documents created on the Portal EPGU and IS "One Window" is performed automatically after filling with the applicant of each of fields of electronic form. In case of identification of incorrectly filled field of electronic form the applicant is notified on nature of the revealed mistake and procedure for its elimination by means of the information message.

The created and signed documents go to the Ministry through the Portal EPGU and IS "One Window" and are registered in case of receipt of information on payment of the state fee for provision of the state service from the State information system about the state and municipal payments.

94.3. In case of filing of application on licensing for export of separate types of the goods specified in subitems "an" and "b" of Item 2.2 of Administrative regulations in electronic form through the Portal EPGU, IS "One Window" without submission of the allowing document of authorized body for export of such goods the statement is not registered the Ministry until receipt in the Ministry of the relevant decision of authorized body.

In case of receipt of data on the allowing document of authorized body the statement goes for licensing for export of separate types of the goods specified in subitems "an" and "b" of Item 2.2 of Administrative regulations in the automatic mode and is registered the Ministry.

94.4. In case of filing of application according to the paragraph of 1 Item 94.3 of Administrative regulations and not receipt to the Ministry of the decision of authorized body and (or) data on payment of the state fee within 30 working days from the date of submission of the specified statement it returns to the applicant through the Portal EPGU, IS "One Window" to licensing for export of separate types of goods respectively without consideration in the automatic mode no later than the day following behind day of the expiration specified in this Item in time.

94.5.
