About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In the Law on National Bank of Moldova No. 548/1995 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 544), with subsequent changes to make the following changes:

1. In part (2) Article 4 of the word "develops and supports the financial system based on the market principles", shall be replaced with words "pursues the aim of ensuring stability and viability of bank system".

2. In Article 11:

in part (the words "according to the procedure established by the Law on administrative court, and requirements of this law." shall be replaced with words 4) "according to the procedure established by the Administrative code in part in which it does not contradict this law.";

add Article with part (5-4) following contents:

"(5-4) Recovery of submission due date of the provisional statement in National Bank and submission due date of the administrative claim concerning acts of National Bank or dissatisfaction in the time of the statement established by the law can be requested by it within three months from the moment of the expiration of the passed term. After the three-months term provided by this part, the passed term cannot be recovered.";

in part (the words "in degree of jurisdiction in the location of National Bank" shall be replaced with words 6) "in Appeal Court of Chisinau";

add Article with parts (10) and (11) the following content:

"(10) In administrative claims concerning administrative acts of National Bank of Moldova the degree of jurisdiction as basis for own assessment uses the complex quality and quantitative standards of the actual situations made by National Bank except cases when the degree of jurisdiction states appreciable error which can lead to the decision, the opposite decision provided in the disputed act.
