About introduction of amendments to the Law on the public pension system No. 156/1998
The Parliament adopts this organic law.
Art. I. - In the Law on the public pension system No. 156/1998 (repeated publication: The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 247), with subsequent changes to make the following changes:
1. Item е) Article 9 to state in the following edition:
"e) early pension for long work.".
2. Part (Article 12 to state 1) in the following edition:
"(1) the Size of minimum pension on age is established annually by the Government and shall be at least equal to the size of minimum pension for previous year indexed according to part (2) Article 13.".
3. State Article 13 in the following edition:
"Article 13. Indexation of pensions
(1) Pensions are indexed every year on April 1.
(2) the Coefficient of indexation equals to annual increment of consumer price index in the year preceding year of indexation. The coefficient of indexation is established by the Government.
(3) the Allowance of solidarity represents not indexed part of pension. Its size changes annually depending on indexation and increase in the estimated pension and change of minimum pension.".
4. Add the law with Article 13-1 of the following content:
"Article 13-1. Increase in pensions
(1) the pension Size estimated according to this law increases annually on April 1 on fixed amount.
(2) the Fixed amount provided in part (1), it is determined by indexation of the size of average pension for 50 percent of surplus of gross domestic product in real terms in previous year. The fixed amount is determined by the Government.
(3) Expenses on increase in pensions are paid from budget funds of the national social insurance.".
5. Add the law with Article 15-2 of the following content:
"Article 15-2. Early pension for long work
(1) the Right to early pension for long work is granted to persons who acquired on insurance periods the insurance years of service exceeding for 5 years for men and for 3 years for women the years of service provided in part (1) Article 42.
