About modification of some legislative acts of Ukraine of rather single legal destiny of the parcel of land and the real estate object placed on it

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. Article 120 of the Land code of Ukraine (2002, 27) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 3-4, in the following edition:

"Article 120. Transition of the right to the parcel of land in case of acquisition of property right to the real estate unit (the apartment house (except apartment), other building or construction), object of construction in progress, located on it

1. In case of acquisition based on the committed transaction or according to the procedure of inheritance of the property right to the real estate unit (the apartment house (except apartment), other building or construction), the property right to such parcel of land at the same time passes the object of construction in progress located on the parcel of land of private property from the previous owner of such objects to the acquirer of such objects, without change of its purpose.

2. In case of acquisition of separate share in the right of common property to the real estate unit (the apartment house (except apartment), other building or construction), the property right to the parcel of land on which such object is placed at the same time passes the object of construction in progress which is in private property of his former owner to the acquirer in proportion to its share in the right of common property to such object, except case when the previous owner possessed share in the right of common property to the parcel of land in other size. If the previous owner in the right of common property to the real estate unit (the apartment house (except apartment), other building or construction), object of construction in progress possessed share in the right of common property to the parcel of land in other size, the property right passes in such size.
