About modification and amendments in some legal acts of the Republic of Kazakhstan concerning activities of the Commissioner for Human Rights in the Republic of Kazakhstan

Article 1. Make changes and additions to the following legal acts of the Republic of Kazakhstan:

1. In the Budget code of the Republic of Kazakhstan of December 4, 2008:

1) of Item 1 of Article 53 to add the subitem with the paragraph the fourth the following content:

2. In the Code of penal procedure of the Republic of Kazakhstan of July 4, 2014:

"8) the Commissioner for Human Rights in the Republic of Kazakhstan - about the circumstances which became known to him in connection with accomplishment of the job responsibilities.";

To replace 2) in part four of article 146 of figure "551" with figures "551-1";

To add 3) with Article 551-1 of the following content:

"Article 551-1. Production of pre-judicial investigation concerning the Commissioner for Human Rights in the Republic of Kazakhstan

1. After registration of reason for the beginning of pre-judicial investigation in the Unified register pre-judicial investigation concerning the Commissioner for Human Rights in the Republic of Kazakhstan can be continued only with the consent of the Attorney-General of the Republic of Kazakhstan.

In cases when the Commissioner for Human Rights in the Republic of Kazakhstan is detained on site crimes or established fact of preparation or attempt at making of heavy or especially serious crime or it heavy or especially serious crime is committed, pre-judicial investigation concerning it can be continued before receipt of consent of the Attorney-General of the Republic of Kazakhstan, but with its obligatory notification within a day.

Production of pretrial investigation on cases concerning the Commissioner for Human Rights in the Republic of Kazakhstan is obligatory.
