About modification of the Budget code of the Kyrgyz Republic

Article 1.

Bring in the Budget code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2016, No. 5, the Art. 398) the following changes:

1) In all text of the Code, except for Articles 29, the word "Government" in different case forms shall be replaced with words "Cabinet of Ministers" in the corresponding cases;

b) declare item 4 invalid;

c) in Item 38 to replace the word "predicted" with the word "planned";

d) add with Item 38-1 of the following content:

"38-1) forecast of social and economic development of the Kyrgyz Republic - system of scientifically based ideas of the directions, criteria, the principles, the purposes and priorities of social and economic development of the Kyrgyz Republic for the forthcoming period with indication of the main predicted indicators and target reference points;";

e) add with Item 40-1 of the following content:

"40-1) system of the state forecasting in the Kyrgyz Republic - the set of the interconnected elements consisting of the principles, documents, processes and participants of the state forecasting, providing development of the country on medium-term (from 3 to 5 years), long-term (for 10 years and more) the periods;";

e) in Item 42 to replace the word "predicted" with the word "planned";

Shall be replaced with words 4) regarding the 4th Article 6 of the word of "The budget resolution of Jogorku Kenesh" "The main directions of fiscal policy";

Part 6 of Article 8 to state 5) in the following edition:

"6. Functional classification represents classification of budgets expenses according to the purposes and tasks of state bodies and local government bodies depending on the functions which are carried out by them.";

"1. The income republican and local budgets is the money arriving in the relevant budgets of the Kyrgyz Republic in type of tax, the customs payments, non-tax payments, fees, insurance premiums, assignments and charges established by regulatory legal acts of the Kyrgyz Republic and also in the form of the received transfers.";

7) regarding the 2nd Article 23:

a) declare Item 1 invalid;

b) state Item 5 in the following edition:

"5) deterioration in epidemiological situation;";

To state part 2 of Article 24 in the following edition:

"2. The size of reserve fund of the local budget shall constitute no more than 2 percent from amount of expenses of the corresponding local budget (without means of reserve funds and receipts from rendering municipal paid services of executive bodies).";

The Code to add 9) with Article 24-1 of the following content:

"Article 24-1. Fund of the President of the Kyrgyz Republic

1. Creation of Fund of the President of the Kyrgyz Republic is provided in the republican budget for the next fiscal year (further - Fund of the President).

2. Sources of Fund of the President are:

1) budgetary funds no more than 1 percent from the approved expenses of the republican budget (without the amount of Fund of the President);

2) the means compensated on corruption cases;

3) other sources which are not prohibited by the legislation of the Kyrgyz Republic.

3. Fund of the President is allocated on:

1) financing of investment and infrastructure projects;

2) improvement of economic and social situation of the population;

3) financing of the educational programs and students studying according to educational programs abroad;

4) other actions determined by the decision of the President of the Kyrgyz Republic (further - the President).

4. The procedure for use of fund of the President is determined by the decision of the President.

5. In case of non-use on the above-stated purposes fund of the President is allocated for reducing budget deficit.";

Article 25 to state 10) in the following edition:

"Article 25. Reserve funds

1. Creation of reserve funds of Toraga of Jogorku Kenesh of the Kyrgyz Republic (further - Toraga of Jogorku Kenesh) and the Chairman of the Cabinet of Ministers of the Kyrgyz Republic (further - the Chairman of the Cabinet of Ministers), and also plenipotentiaries of the President in areas and heads of local public administrations is provided in the republican budget for the next fiscal year.
