About introduction of amendments to some laws of Ukraine concerning public health care from harmful effects of tobacco

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. In the Law of Ukraine "About state regulation of production and the address of alcohol ethyl, cognac and fruit, alcoholic beverages, tobacco products, the liquids used in electronic cigarettes and fuel" (Sheets of the Verkhovna Rada of Ukraine, 1995, No. 46, Art. 345 with subsequent changes):

1) in Article 1:

the eleventh to state the paragraph in the following edition:

"tobacco products - products which can be used for consumption and which part is, even partially tobacco irrespective of, is it genetically modified, or not";

to state the paragraph of the thirty sixth in the following edition:

"the medical prevention of consumers of tobacco products - the term is used in the value given in the Law of Ukraine "About measures concerning the prevention and reduction of the use of tobacco products and their adverse effect on health of the population";

add with the paragraph of the following content:

"The terms "introduction into circulation of tobacco product", "electronic cigarette", "tobacco substitutes", "filling container", "outside package", "ingredient", "smoking of tobacco products", "the latest tobacco product", "snuff tobacco", "single pack", "objects connected with the use of tobacco products", "workplace", "cigarette", "cigar", "cigarillo", "vkuso-aromatic additive", "pitch", "consumer of tobacco product", "tobacco", "tobacco for hookah", "tobacco for tube", "tobacco for peroral application", "tobacco for roll-ups", "tobacco smoke" are used in this Law in the values given in the Law of Ukraine "About measures concerning the prevention and reduction of the use of tobacco products and their adverse effect on health of the population";

2) in Article 11:

third to state part in the following edition:

"3. Marking of tobacco products which are implemented in Ukraine is performed thus:

on each unit of tobacco product (cigarette, cigarette, etc.) own name of product is specified.

On each single pack, box or souvenir box it is specified:

name of the manufacturing company or tobacco company;

general and own names;

availability of the filtering mouthpiece;

quantity of units in single pack, box or souvenir box;

medical preventions which are put according to the requirements established by the Law of Ukraine "About measures concerning the prevention and reduction of the use of tobacco products and their adverse effect on health of the population";

designation of the regulating document;

bar code.

On outside package (except for transparent wrappers) in which products are in packs or boxes, it is specified:

general and own names of product;

quantity of units of production in packaging;

medical preventions which are put according to the requirements established by the Law of Ukraine "About measures concerning the prevention and reduction of the use of tobacco products and their adverse effect on health of the population";

bar code.

On transport container it is specified:

general and own names of product;

name of manufacturer and its location;

quantity of units of production in packaging;

date of production;

designation of the regulating document (for products of national production intended for realization in the territory of Ukraine).

Signs for goods and services on tobacco products are carried out in language and in the form of the registered original or the image provided in the request for registration of sign accepted for consideration for goods and services.

Products intended for export are marked in accordance with the terms of the relevant agreement for export";

in part four:

the paragraph one to state in the following edition:

"4. The producer can place on labels the additional information about product characteristics. At the same time tobacco product manufacturers are forbidden to place on labels information prohibited by the Law of Ukraine "About measures concerning the prevention and reduction of the use of tobacco products and their adverse effect on health of the population";

3) in Article 15-2:

state the name in the following edition:

"Article 15-2-. Restrictions regarding beer consumption (except nonalcoholic), alcoholic, low alcohol beverages, wines of dining rooms, the use of tobacco products, use of electronic cigarettes and devices for consumption of tobacco products without their combustion";

second and third to state parts in the following edition:

"Restrictions concerning the use of tobacco products, uses of electronic cigarettes and devices for consumption of tobacco products without their combustion and responsibility for their violation are established by the Law of Ukraine "About measures concerning the prevention and reduction of the use of tobacco products and their adverse effect on health of the population" and the Code of Ukraine about administrative offenses.

For the period of holding mass actions village, settlement and city councils within the corresponding administrative and territorial unit can prohibit or limit beer consumption (except beer in plastic container), alcoholic, low alcohol beverages, wines of dining rooms and smoking of tobacco products, use of electronic cigarettes and devices for consumption of tobacco products without their combustion";

4) in Article 15-3:

state the name in the following edition:

"Article 15-3. Restrictions on beer sale (except nonalcoholic), alcoholic, low alcohol beverages, table wines, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes and devices for consumption of tobacco products without their combustion";

the first - the fifth to replace parts with six new parts of the following content:

"Beer sale (except nonalcoholic), alcoholic, low alcohol beverages, table wines, tobacco products, electronic cigarettes, the liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion is forbidden:

1) persons which did not reach 18 years;

2) to persons who did not reach 18 years.

Beer sale (except nonalcoholic), the alcoholic, low alcohol beverages, table wines, tobacco products, electronic cigarettes and liquids used in electronic cigarettes, devices for consumption of tobacco products without their combustion is forbidden:

1) in rooms and in the territory of educational institutions, health care institutions (except the restaurants which are in the territory of sanatoria);

2) in premises of the specialized trade organizations performing trade in goods of children's assortment or sports goods and also in the relevant departments (sections) of universal trade organizations;

3) in the closed sports constructions (except beer in plastic container);

4) from vending machines;
