About introduction of amendments to the Law of Ukraine "About public purchases" concerning creation of premises for sustainable development and upgrade of the domestic industry

The Verkhovna Rada of Ukraine decides:

I. Introduce in the Law of Ukraine "About public purchases" (Sheets of the Verkhovna Rada of Ukraine, 2019, No. 45, Art. 289 with subsequent changes) the following changes:

1. To add part one of Article 1 with Item 29-1 of the following content:

"29-1) extent of localization of production - indicator of local component in specific weight of cost of raw materials, materials, nodes, aggregates, details, components and components, works, services and other components of national production in cost of the goods which are purchase subject".

2. The second Article 6 to add part with the words "and also taking into account the requirements for extent of localization of production established by the law".

3. To add part one of Article 43 with Item 5 of the following content:

"5) if the name of subject of purchase with indication of code according to Single purchasing dictionaries does not correspond to goods, works or services which actually purchased by the customer".

4. To add the Section X "Final and transitional provisions" with Item 6-1-of the following content:

"6-1. Temporarily, since 2022 for a period of 10 years, features of implementation of purchases are established if the cost of subject of purchase is equal or exceeds 200 thousand hryvnias:

1) the customer conducts procurement of the goods determined by the subitem 2 presents of Item, is exclusive if their extent of localization of production is equal or exceeds:

in 2022 - 10 percent;

in 2023 - 15 percent;

in 2024 - 20 percent;

in 2025 - 25 percent;

in 2026 - 30 percent;

in 2027 - 35 percent;

from 2028 to day of completion of 10-year effective period of this Item - 40 percent.

Extent of localization of production is determined independently by the producer of the goods which are purchase subject and is confirmed by Authorized body according to the procedure, established by the Cabinet of Ministers of Ukraine, on formula:
